MN1 Registration - Section 1(3) of British Nationality Act.

Hi,

I am applying to register my son as British using the MN1 as he was born in the UK. I the father have recently obtained ILR through 5 years as Tier 1 General and his mother is currently on Tier 1 General dependent visa.

Section 1.1 asks the question "Please indicate the section of the British Nationality Act 1981 under which you would like the application considered. See chapter 2 of the guide for details"

Chapter 2 in the guide, pg8 quotes as below,
Section 1 (3) - A child born in the UK whose parents are not British citizens and
were not settled in the UK (see page 6) will have an entitlement to register when
their parents become settled in the UK
or become British citizens.
As far as I am am aware, the child is entitled to register as long as either of the parent have obtained ILR. However in the above quote it says 'parents' in plural instead of 'either parent'.

This document was updated in December 2015, so I am wondering if this was a recent change in rules ?
Would much appreciate if someone could clarify and provide a reference as well.

No change. One parent needs to hold ILR. A registration under 1(3) which is an entitlement can't be refused.

Agree.

What has been spotted (above) is a known error/typo in the MN1 Guide.
(At least its known in this forum).
