You became a family member on the date of your marriage.

However, for legal residence, you also have to show that your spouse was a qualified person or had acquired PR, before your divorce.

Therefore,

Given your illegal entry and lack of supporting documents from your ex spouse, I would err on the side of caution and use their confirmation of your right of residence as the starting point.

I would add that to be consistent, it's safest to say that you were legal at least 5 years prior to PR.

i already demonstrate for the HO that my ex wife exercising her right of residence by working full time(march 2007 to decree absolute dec 2010) when i applied for retain my right of residence after divorce(ROR)
and i shown them her documents again when i applied for
-PR(march 2007 to dec2010 her documents+jan 2011 to march 2012 my documents)
-citizenship (i didn't wait one year after received PR I applied 6 years from the day of marriage march 2007 to march 2013 )

I would add that to be consistent, it's safest to say that you were legal at least 5 years prior to PR


i received my PR on july 2012 but on the sticker is writing june 2012

when is the safest day to apply for citizenship?

Probably from June 2017. Any earlier, they may want you to reproduce the documents from your ex wife, that you do not now have.

However, perhaps best apply for SAR first, to see what info they hold on you. It may indicate when they deemed you to be legal or when you actually qualified for PR.

definitely i will apply for SAR to see what record HO hold on me but
do you know how I can request the data same ohara page

When I filled in the SAR form, I ticked the boxes asking for everything.

When I received it there was about 60 pages, and that was one of them.

i'm about to apply for SAR i wondering if i can ask them to tell me when I'll be eligible to apply for citizenship according to what they hold on me rather than they give me what they have on me and i decide the right date to apply by myself which i could be wrong

refresh my my story and let me know when i'm eligible for naturalisation

I'm non eea citizen come to UK on 2004 clandestinely
-March 2007 get married to my ex wife (eea citizen)
-May 2007 Applied for residence card
-May 2007 received my (COA) allowed me to work
-Received RC on September 2007
-Start work on 2008 till today
-march 2011 retain right of residence after divorce(ROR)
-JULY 2012 received my permanent residence dated juin 2012
-march 2013 Applied for citizen application
-may 2013 have domestic violence caution(with ex wife) while my application was on progress
-Juin 2013 application refused due to police caution and advised to apply on may 2016 (3 years later)

i received my SAR last week and unfortunately there is no acquired PR date on anywhere on the 30 pages that HO sent to me but there is proof that:

-)my ex wife was exercising her treaty right as worker from 31/10/2005 till the date of decree absolute
-)my ex wife has been issued with registration certificate on the basis of 12 months autorised WRS empoyment .

and also I have
-)my ex employer letter show my ex was working continuously from 31/10/2005 till sep 2010
