Wow why they say in there website we have to wait 12 month after holding PR TO apply for citizenship or this for people who enter uk legally only .

One of the requirements for naturalisation is that you are free of immigration time restrictions for at least 12 months prior to the application. In effect, this means you should hold PR/ILR for at least a year before you apply for naturalisation. The requirement is waived if you are married to a British citizen.

So what would happen if the application is refused?
(if it depends on the basis of rejection, I have 91 absences when only 90 is allowed)

There is no right of appeal as such. Only a request for re-consideration or a Judicial Review. This is due to British citizenship being a privilege rather than a right, unlike visa applications.
You are entitled to re-apply as soon as you feel you meet the conditions for which your application has been refused.

I am assuming you have 91 days absence in the 12 months prior to submitting your application. It is possible that this extra 1 day will be allowed/overlooked.

hi Shaha93,

With more recent cases we have seen money taken off account quite close to bio-metrics letter date.
In your case, I believe it's simply the wait before it gets assigned to a caseworker.

I would call the home office with your original reference number and ask them to confirm.

£80 will taken don't worry.
And there is not time limit for reconsideration.
After 8 months Some one receive approval.
And most them are refuse base on over stay and breaking rule.

I apply for nationality in March 2013
Application was refused on good character bas
Then I apply again December 2014
Refused again and HO said tha you not mention on you r previous application the convection
I was already clearly mention I was had convection

Submitted a Reconsideration Application on 13/04/2015.
9 and a half months later - still waiting...

So stop winging everyone and just wait. There is nothing we can do anyway.

why did they refused you in the first place and what was the reconsideration based on?
Thats a lot i have to say - how long has it been in total since your initial application ?!

I applied for British Citizenship on 19/05/2014.
Got a refusal letter on 12/03/2015 (10 months later).
Submitted a Reconsideration Application on 13/04/2015.
It has now been over 6 months and no decision (no calls or letters from HO either).

Frustrated...

They said I have not spent a continuous period of 5 years in the UK – here they may be referring to the time spent outside UK (under 12 months) when my mum was undergoing cancer treatment. Clearly, an absence of up to a year is permitted if it’s on the grounds of serious illness which it was. Supporting documents submitted.

Now after waiting for a year for their decision, it is definitely more than even 6 years.

I applied in the first place after being in the country for 5 years 2 months.

Well maybe the reason for the long delay is actually in your favour - maybe they're trying to let enough time go so you can qualify without reason of doubt
I have to say applying for AN 5 years and 2 months after knowing that you have been out of the UK cumulatively for more than the 450days limit is a risk you took upon-yourself
Retrospectively thinking now - maybe you should have waited till 2015 and you might have had your Certificate by now;
But as I was saying maybe I am sure its on its way

Hi I applied for citizenship in May 2015 and my application has been refused as they say I obtained toeic with help of a proxy test taker. I was refused ilr on the same allegation and I had submitted my toeic and ielts certificate that they didn't see.i wrote them a letter saying I have sent them ielts.i was given ilr after which I went to my home country on my return I faced the same question from border control that my toeic was fraudulent they held me for five hours and later appologized and cleared me .now I have been given nr application form for review I don't know where I stand.
