Benefits affecting ILR....Confusion

Post by its_capricorn » Wed Jan 14, 2015 2:34 pm

Hello ,
Can someone help me please.
I am going to apply for my wife's ILR in Mar 2015.Just read the following on UKBA website.

When you apply for settlement, you and your partner must:

1: be living together in your own accommodation
2: not be using public funds

At the moment we receive Child benefit on my name and Child tax credit and Working Tax Credit as a couple.
UKBA website clearly says you and your partner must not use public funds.
Could you please guide me on this.Do I have to stop claiming these benefits ??

Thanks

This is fine and HO are aware. Many people on the forum have had success claiming these two benefits.

What is your current visa status? Is your spouse British? You should not be claiming any benefits in your name alone if you have not got ILR.

You are not entitled to claim ANY benefits. Best to contact the relevant departments and cancel your claim and pay the money back asap BEFORE you apply for ILR or any visa extensions.
