I am an Indian citizen currently on an ILR from Jan 2011. My child is an Indian, born outside the UK and is currently in the UK on a dependent visa with no recourse to public funds.
I am trying to understand if the child benefit eligibility is considered based on the child's visa status or the parent's visa status? If it is based on the child's visa status it is obvious that he is not eligible.
I had submitted a query with the child benefit office stating both my status as ILR and my child's status as a dependent visa and I received the below response
I will appreciate if someone could please clarify.As you hold the correct immigration status to receive Child Benefit you should apply for benefit and I shall enclose a claim pack to your home address. Please enclose all Home Office documents, originals are not required as soon as possible and we will inform you of the outcome.
If you have "no recourse to public funds" you will not be able to claim benefit as Child Benefit is a public fund.
