What benefits can husband claim while wife still on appeal

Hi

I just received my ILR on 10 year long residence basis

I have 2 kids, both born in the UK, which I am registering as BC by filling MN1

My wife appeal for dependent visa still pending because of English Test


Please guide me which benefits can I claim safely and which benefits should I avoid so that it doesn't affect my wife Appeal and visa

You can only claim what you are entitled to claim based on your circumstances.

You can use the benefit calculator to see if you are entitled to anything. Input that you are British to do the calculator.

If you qualify, you must claim child benefit in YOUR name ONLY.

If you qualify, you must claim tax credits in JOINT names with your spouse.

So I will just claim


Child benefit in my name


And ctc in me and wife name


Will this not affect my wife application as wife visa still pending

Housing benefit ?

As my landlord has given me sec 21 eviction notice

Will council help me as my wife appeal still pending

And can I take house on DSS or can I claim housing benefit or it will affect wife ?

S21 is a notice to quit so you need to find another place to rent. It's just a notice, but eventually you will need to leave so find another place asap.

You can only claim housing benefit for those that hold ILR or British citizenship, not for those that don't. If it is only you then HB will be the one bedroom rate if you ae age 35 and over. It will be just the single room shared house rate if you are under age 35. The maximum rate of HB you can claim, will be reduced by your households (you and your wife) salaries.
