EEA citizens are not required to submit biometrics for EEA residence documentation applications.

Hello All

I just started to complete the EAA (PR) form and i have some questions if somebody can give some answers !

1. I'm a Romanian citizen and I'm in UK Form 2008 .

So i need to send my prove of employment, address etc for the last 5 years of residence .

On page 47 at section 9.4 they request all my employment/self employment history from the moment I'm in UK. They need just this info or i need to send all employment proof starting with 2008 ?

2. In 2011 i received a caution from police. I know the cautions are A non-custodial offence or other out of court disposal that is recorded on a person’s criminal record for the 5 years when the caution is spent.

My caution will be spent in June this year so in the same month with my application. I know they don't accept applications with cautions received for the last 3 years .

It is going to cause me problems ? Because i need to complete this in the application as they will check criminal records and the caution will appear forever.

3. Should i send original + photocopies? as i didn't find nowhere this requirement.

Hi Ohara, could you please explain a bit more, why do you think that 12 months period is not needed in this case! i'm a bit lost here! as far as i know my partner (EEA national) had to wait for 12 month!

You don't apply for PR.

If you have acquired PR (it is automatic) in December 2010, then you will be able to apply for naturalisation in December 2011.

Has anyone requested/received their documents back in the past month?

I put in a request to get my Romanian ID sent back and haven't heard anything. After 2 weeks I sent in a request saying that the 10 day margin has passed and I haven't received my documents... and another 10 days have passed and still nothing.

Anyone?...

Hi all

Has anyone recieved their DCPR who applied for Permanent residance in December 2015? I have seen some thread that some members have recieved their DCPR who applied after December 2015.

My timeline:

Applied:01December 2015
Application Recieved: 02 December 2015
Received Acknowledgement (via e-mail): 17 December 2015

What have you applied for? A residence card is not a DCPR...

I applied for DCPR in mid December and got it mid February.

Hello Everyone,

I was wondering anyone sent the EEA (PR) as Non- Eea during Nov 2015.?
I am still waiting for the PR card. Starting a bit nervous.

Here is my timeline.
send application on : 25/11/15
Ho received on : 26/11/15
Payment taken on 30/11/15
Biometric letter dated on 14/12/15
received on 17/12/15
COA dated : 05/01/2016
PR Card : Still waiting

My Employer did check with Home office in February and everything is fine , Ho reply back within 5 days.
Now I am still waiting and it has been 5 months almost 6 months I am getting worried , in the letter said after 6 months employee should be asked to present his or her residence card as evidence of continuing eligibility to take to continue in employment in the UK.

Which mean my job at risk then.
Anyone sent PR out around those time and have heard back from HO yet.?

What should I do next.?
Please advised.
I am super stress now.

Hiya,

Why would you be a stressed when you still have a month left?? If your employer asks again just be honest and say you still haven't rather than haven't heard from HO! just be cool, i'm not just saying that for the sake to make you feel better, i'm saying it cos it's truth and it's true they are slow and taking time, and as far as i know they are more aware about it now, especially when the deadline (6 months) is approaching!! So pls forget about it and hopefully will be with you soon! Just don't panic and pls don't show that to your employer!!

Hello beaujam, have you tried to contact the home office ?
I have one friend that requested his Italian passport back and and now still waiting 5 months for the pr card. I don't know why some eea taking 2 months and some taking longer. Looks like they are busy . Good luck for us .

Update: My PR is refused.

Reason for refusal: Even though you meet all other residence requirements, you have failed to provide evidence that since your divorce on 14 October 2015 till the 4 November 2015 that your application was received by UK visa & immigration, you have been a worker, self employed person or a self sufficient person, how ever u have failed to provide evidence that you meet requirement of regulation 10(6) and you have therefore not retained a right of residence following divorce .

6 years utility bills joint
6 years Payslip (my Self) including period claimed in refusal

Am sorry about the refusal, the first thing you need to do is be calm as difficult as that sounds. You need to write to your caseworker asking for a reconsideration on the grounds that you have provided evidence of you exercising treaty rights from divorce till date of application. This should highlight the error the caseworker has made.
I've come across situations whereby rather than say you've provided a copy or printed copy, they've disregarded the supplied information as not provided.

Sorry to hear they refused. You have 10 days to appeal
An advice from a solicitor might be helpful, from £30,
Send them evidence that you were exercising treaty rights for the period. Payslips , Letter from your employer etc, also the proof of residence for that period i.e. Tenancy agreement or bills.
