Derivative Residence Card

Post by taz1234 » Tue Jan 03, 2017 10:58 pm

Dear All,
I need some help regarding Derivative Residence Card. The first information is I am fulfilling all the requirements of Derivative Residence Card and I can apply on my son's behalf who is 9 months old and is in my full custody. my questions are
1. Is there any chance to get indefinite leave to remain at any stage?
2. Can we apply any sort of benefits while on Derivative Route?

Thanks in Advance,
Taz

1. No, derivative residence card does not lead to PR or ILR.

So what option we would have in future to get a PR in the UK?

What is your son's nationality?

Are you currently in the UK?

Where is child's other parent and what is their nationality?

You would have to find a visa route that you qualify for which would lead to ILR/PR.

I live in UK and I am on Business Visa (50,000) Enterp. My son is Lithuanian and lives with me and I have the full custody of my son and I am a single dad now. my Ex-gf is also Lithuanian and lives in UK somewhere. we do not have any connection and there is no contact between my son and his mother. My visa is expiring in Nov 2018.

How long have you been on a Tier 1 Entrepreneur visa?

Did you have any UK visa prior to £50k Tier 1 Ent?

Can you not continue on your current visa till you qualify for ILR under the long residence route?

I can but the only reason and motivation to think about "Derivative Residence Card" was the easy access to work (Job) and may be benefits and also to bring my wife or parents on the behalf of Derivative Residence Card which is easier (i think)

Derivative rights are very limited. You wouldn't be able to sponsor family members willy nilly via derivative rights.
