Divorce of an EEA National, want to stay in the UK but HOW?

Post by CorbinDallis » Tue Mar 29, 2011 10:46 am

Hi Everybody

I got married in South Africa (I am South African) to a French woman in early 2008, We then moved to the UK in early 2009 which I then applied (in England) and received a ‘Residence Card of a Family Member of an EEA National’ to work and live in the U.K. We decided to get a divorce and are no longer living together since early 2010.
We have been married for for just over 3years now and I have documentation proving we were living together for a year within the UK, ie Utility Bills. Her P60's and payslips
I have the marriage documents from South Africa. I also have her co-operatoin on the matter. I have been working the whole time since my arrival in the UK.
How Do I go about staying in the UK being able to live and work?
Do I have to get a divorce first before I can take the next step?
Will I have to go back to South Africa to attain the divorce?
After telling the Home Office will they expect me to leave straight away?
Can I do all of this without leaving the country?

Anxious Safa eagerly awaiting a responce!
