EEA EFM for failed asylum seeker

EEA EFM for failed asylum seeker

Hello Everyone ,

I m quite new to this forum .

My partner is a failed asylum seeker since 2011 and he hasn't got any type permit to live in the U.K.

I am a self employed person owns a ltd company . Which I get directors salary .

Due to his status he cannot open an bank account or have bills in his name . But we been lived together for more than two years

I can take him to Portugal and apply for a Portuguese nationality on the basis of lived together for three years "union defacto"

But Portuguese embassy won't let him to have schengen visa unless he is legally in the U.K.

I have pictures And other sort of documents . But I don't have council tax bill or utility bill together name .

He don't have bank account as well

My children's father left us in a horrible suitiation and He is one who has been our back bone and looked after my children's as well as without him I wouldn't able live my life . He is done so much for us and he never asked me anything . His family sends him money from back home and he never asked money .

Do you think he will send back to the country if he apply for one ?

How we can prevent from deported ?

We can't get married as well due to his status .

Any other chance I can take him to Portugal even he is illegal in the U.K.

Any advice much appreciated

This is confusing. How many gentlemen are you discussing here?
partner?
children's father?
someone's family (childrens' father's family?) is supporting who?

Where does EEA EFM RC come into picture?

Suggest return to some country from where partner can apply for Schengen visa and go to Portugal from there.

My current partner ( He is not the dad for the children's ) is an asylum seeker and he gets supports from his family back home for his living

The second gentlemen is the children's father who left me and my children's three years ago .

Due to me and current partner living together for more than two years can I able apply EEA EFM for him .

My children's father don't support anything .

An applicant can always apply.

For EEA EFM to fly you will need to prove:
  • both your identities;
    a durable relationship akin to marriage - for 2 years or more;
    you (sponsor) are a qualified person exercising treaty rights (or else settled);
    both party's residence in UK;
Rock-solid documentary supporting evidence will be needed on all fronts.

The only thing I m worried is he get deported incase if it's get rejected .

We can make it as much as we can .

The following document we have so far

1. Family picture's
2. Phone bills on our names
3. Gift cards & Present's
4. Both Passports ( Partnets with home office )
5. Travel History within the UK
6. Phone chats

Please suggest more document's which add more weight to our application

It doesn't seem to be enough.

You need to prove:
both your identities;

Where are your docs?
More of joint life?
Presence/residence?

You are trying to prove a relationship 'akin to marriage' not just good friends or even gf/bf.

Yes, if you fail partner is potentially facing detention and admin removal under EU rules if not deportation under
UK Regs.

Best bet is still probably to go abroad, marry somewhere;
come back with hubby on FP.

How old are you kids, how long have they lived in the Uk for, and what roles does he play in their lives?

I have two children's one boy is 18 and another one girl 14 .

He does everything for them like an actual dad do .

He can't go his back home due to his problem .

Literally I have two options which I can take him to Portgual and register but he needs to legal in the UK to get the visa .

What I wanted to know if he apply for one and if he gets COA will that be enough to get sechgen visa .

Or else can I able to go to Portugal embassy ask for a visa without applying EFM

How long will it be take to get EEA FP from abroad . He hasn't got good record with Home office .

I got business so I can't spend more than two days out of the country whenever I wanted . I manage the whole business . No other people work for me

I m a qualified person worked before self employment and I m sure that I m paying enough tax . I m self sufficient too . I have savings in the bank

Is there any way I can open a bank account for him without documents.

Do I need to include my children's in the application coz they are EEA nationals

The documents is with us .

So how long has your 14 year old child lived with you in the UK, and have you secured the right of permanent Residence?

She always lived since I moved to England (2013) .

My son moved out last month .

We are planning to get married next year or year after

I m doing my tax returns on March .

I have prepared following documents

1.My Photos literally more than 200
2. Travel and some hotel Bookings
3. strong letter from my friends
4. Some bills
That's all i got it for now

If I don't try I don't get it . So I m planning write a cover letter about our suitation and stuff .
