What do my family do after 6 months? Leave UK and apply for the permit again?

Dear everyone,

I am new to this forum and want to know if anyone can share their opinion with me so that I can get to know more information. I have an elderly mother (68 years old), a divorced sister with her son (6 years old) are living with me. I have an EU passport (non-UK). I came home (4 months ago) to stay with my mother because my father is not longer with us. My divorced and her son just moved in last month. I read in the UKBA website that my mother will be classified as family member if I apply for an EEA Family Permit. If she qualifies for it. I would like to know if I can bring my mother along with my divorced sister and her son to move to UK and live there. I read in the UKBA website that I could bring my family members to UK if they were the member of my household. In my case, will my mother, sister and her son qualify as member of household?

Thankx.

Hi,

Thank you for your link. I know my mother will qualify for the family member. I would like to know how will it work out for my sister and her son which are living under the same house with us. I read some of the cases in this forum already. It mentioned in UKBA guideline about Extended Family Member. They have to be my household member. I am confused. How long do they have to live with me in order to qualify or if they qualify at all since they are not my direct family anymore. Also, I read that EEA Family Permit only valid for 6 months. If my mother is granted EEA Family Permit, after she arrives in UK, she will have to apply for a residence card which could take her long time to get, right?

Many Thanks

Not sure about your first question.

The residence card application can take about 6 months.

Please note that you will need to prove their dependence on you.

Thank you for your reply. I certainly know that my mother will qualify for the EEA Family Permit because she is not working so financially she is depending on me and I can prove that with my banking info. I read the Dauhoo case about the household membership but I do not undertand it because it is a legal document. I would like to know if my Sister and her child would come under the household membership rule without depending on me. Certainly my sister and her child is living under the same roof as me and my mother, but will this make them qualify the household membership rule at all? Or there are more requirements for household membership?

Thank you.

I really don't know but I'd assume they need to be dependent on you too. If it was just a case of living in one house that would be a little too easy.

I hope someone else will come and answer you soon!

Hi,

Someone from another post told me that the EEA FP is only valid for 6 months and afterwards, my family member will have to apply for residence card in UK. I would like to know if EEA FP has been granted and my family member entered UK and apply for residence card, will they subject for checks or further checks by HO or getting a residence card after EEA FP is just a formality and matter of processing time?

Thank you,
bhutangang

In the UK registration and application for a residence card is not mandatory. The holders of residence cards are not required to inform our authorities if there are any changes which affect their status under the Directive. It will be issued within 6 months
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020

Article 10 Residency Card and EEA Family Permit

Post by bhutangang » Mon Nov 28, 2016 3:40 pm

Hi,

I have some questions. If my non-EEA family member (Parent above 65) has been granted a residency card based on my EU nationality in one (not my EU nationality) of the EU member states. If I move to UK, can my parent join me or my parent will have to apply for an EEA Family permit before hand? If my parent does not need to apply for EEA Family permit before coming to UK. Does my parent need to apply for an EEA permit once entered UK in order to live in UK?

Thx

Parent may be able to enter UK with Article 10 RC.

FP is not issued in UK nor required once in UK.

As advised in previous posts (above), optional RC is next step. Proof of dependency required.

So does it mean my mother needs to apply for RC in order to live in UK or she can just living with me with the Article 10 card along without getting into any trouble?

Noone can rely on another country's RC once in UK.

The right to reside is based on sponsor, and for a parent, depends on proving dependency for essential daily needs.
Rather than carrying a few kgs of documents around all the time a RC is a convenient confirmatory document.
