Hi,

I read one time somebody that tried the reconsideration and it works and he was in the same case as me so maybe it changed this year I don't know.

I totally agree the HO told me that the appeal was faster 4 months without choosing the hearing so my husband and I decided to go for it..... now that we know that it can take more than 1 year it's driving me crazy. It's been almost 1 year since my first application and 4 months since the appeal!

So basically if you have a decision from the tribunal, you'll have to wait 3 months and after those 6 months for them to give you your RC???? OMG so around 1 year and a half..... jeeezzzz!!!!

May god help us.... this is crazy....

Hi everybody
I am silent rider from last year when i apply for my visa. I am the visa national and my wife its the sponsor.Last year i submit my application and april this year we had home office visit in our home after short time we got refuse on a stupid grounds from which they say its marriage of convinience.Then we went for appeal with oral hearing on 9 november we went in the court with my wife and our witnesses .At the court HO was unpresented and we had only our barista and thu djudge inside.She ask us some questions and we finished for less then an hour.
Thats our short story.My questuions to all the members of this great forum and specialy to the gurus here its:
How long after the case its herd in the court we will receive decision?
Its there any one who got an appeal where therer HO wan upresented and what was the outcome of the
case ?
Since we applied last year November if our appeal is allowed and HO does not chalenge the decision of the djuge how long its gona take them to send my visa and its gona be in my passport or like the new one RC like credit card .

Hi i choose hearing appeal because HO has accused me of being married to my wife just for the sole purpose of me remaining in the country which in- short marriage of convinience. I choose the hearing because that way you can go with your partner and the Judge can see you both and will have the chance to talk to you and ask you questions and also the HO can see you.In my case there where not there and the Judge allowed my appeal on 19 of November.I got the letter on 24 of November.Today 1 of December i got letter from my solicitor to submit my passport again to the HO in order to implement the decision on my case.

Hi sory i could not answer your question early hope so its not very late.I got my refusal letter on 5/5/2014 and then i lodge my appeal.After that i got letter with a date for the appeal maybe arround 5,6 September and with last day for sendning more evidence 27 September.My hearing date was 9/11/2015 .Judge got desicion on the same day ,but written on 14/11/2015.Desicion promolguleted on 19/11/2015.Desicion sended to me on 24/11.Then i got letter from HO requesting me to submitt my paspport in order to implement the judges desicion i think so was arround end of November .And 24/11/2015 i got my Christmas present wich was my VISA. I am so happy that nightmare was over.

Bio letter : 21/07
Bio sent : 28/07
COA date : 10/08
Refusal date : 19/12
Reason, eea sponsor not registered in job Center as job seeker and no proven income.
We choosed not to appeal and sent another application on Thursday 24/12 with all documents required as my spouse is employed now. Still not sure if it's the right thing to do!
We are still within the appeal timeline, advices would be appreciated.

Hi all PLEASE DO THIS TO HELP NEW PEOPLE COMING:

I am willing to collect all the timelines on one post for all the appeals starting from 2015 here is my full timeline please share yours so we can know approx. all the timeline and the reason why your application was refused:

Situation: Non EEA married to a French National

Application sent: 09/01
HO received:12/01
Email of confirmation: 13/01
Letter of confirmation:20/01

Application Returned due to fees : 11/03 (they tried to take the money but where not able to do it, my bank told me that no attempt was made....)

Re-applied with a postal order:12/03
HO received: 13/03
Email of confirmation: 16/03
Letter of confirmation: 20/03

COA: 25/03 (dated 20/03) with right to work

EEA refused : 13/08/2015
Reason : my husband changed work and didn’t notify the home office so they’re considering that he wasn’t exercing his treaty rights.

Reconsideration sent to HO : 14/08/2015 with all the new documents (new contract) and contact, emails, mobile phone etc...
Received : 15/08/2015
Refused/ 19/08/2015 because we should have known that we had to send the new employment contract to HO...

Appeal sent : 20/08/2015
Received : 21/08/2015
Right to send documents until 30/09/2015
Letter from HO: 29/09/2015 saying that they send all the relevant documents to the Tribunal. They gave me a copy of all correspondance between me and them, all my applications and documents submitted

Choice of hearing : Paper
Hearing date :will not be notified about it since I choose not to attend the hearing (in the appeal they said it would be faster to get a decision by choosing that method)
Appeal allowed/refused : pending
RC : waiting

Just found a case Of someone who appealed the refusal of her EEA2 last April/2015 and just received a letter on the 23/01/2016 confirming his hearing date on the 15th of April 2016 !!! :0

Ok great idea for the signature. Can you just add the reason Of refusal and the nationality Of the eea member. If you choose a hearing date and Will attend or if it's on paper. That way others can help with calculating an approximate timeline by type of case.

Hi Guys,

My wife received her EEA residence card today. Our timeline is as below:

Application submitted: 5th August 2015
Application received: 6th August 2015.
COA granted: 9th September 2015
COA received: 11th September 2015
Residence Card granted: 29th Jan 2016
Residence Card received: 2nd Feb 2016.

Actually, few days back we had called the Home Office to inquire about the status of the application. The person on the call explained us the following logic for timelines:

1. Home Office considers all applications according to calendar months.

2. Time line for all applications received in month "X" will start from 1st of month "X+1". Hence, for all August 2015 applications, the 6 month time line starts from 1st September 2015 and finish in end of February 2016.

We are still waiting for our passports and other documents. Fingers crossed.

Ment to take up to 3 MONTHS but can be sooner or longer when i was in the same situation it took almost 6 weeks to get my RC, hope this helps and puts your mind at rest i know how stressfull your situation is

Hello Every one

Refuse in june 2013
appeal Court date Jan 2014
Decision wasn't accordance the law appeal allowed refusal letter regulation wasn't correct.
new decision received in feb 2014
appeal court date was September 2014
appeal adjourned on the day because they received my bundle only 4 days before but they had my bundle before aswell
appeal new date march 2015
before my appeal date home office visit me alleging I am over stayer while my appeal pending they use force against me while this I got injuries on the date of march 2015 Home office lawyer said we don't know about this incident we need to question those officer but I did add this in my new bundle which they said they didn't review again appeal adjourned Judge summon HO officer to attend hearing
new date July 2015

appeal allowed in September 2015
ask for new passport on 30 October 2015 as previous expired
send passport first week December 2015
still waiting for RC
WRITE TO CASE PROCESEEING Unit in January 2016 no response any one have there contact details
really frustrated its nearly 3 years and I am not allowed to Work :@
