Post by Chancee » Thu Dec 19, 2013 10:02 pm

Hi every one. I came to UK on spouse visa marriage to EU citizen
Mae got married in Pakistan then applied visa for UK
Now we are living separately and planning for divorce.
My question is we got married in Pakistan do I need to get divorce there? Or here in UK. Our marriage is not registered in UK
Please advice what to do.

There is nothing stopping you from getting divorce in the UK.
However divorce may result in your loosing your right of Residence if you dont meet the criteria for retaining your rights of Residence.

How long have you been married to your wife?

And during this period, have you been residing in the UK throughout ?

What is the validity of the document you currently have?

Yes it will not affect your residency rights I believe, if you already secured permanent residence.

Hi, if the marriage that happened to you was in pakistan originally, are you sure that a uk court can give a divorce for this?
as i was under the presence that you had to go back to the original country to give a full talaq

say if the marriage took place in pakistan and the spouse has never entered the uk and is still living in pakistan, and when the marriage breaks down, can a UK court give a divorce for this? even though the spouse is in pakistan?
