Hi All….

I'll apply for ILR next year in june I'm so Worrying about my absences now I'm on residence card.
so my absences is :



Year 1 is 11 JUL 2015 to 12 JUL 2016 XXXX
Year 2 is 11 JUL 2014 to 15 JUL 2015 XXXX
Year 3 is 14 JUL 2013 to 15 JUL 2014 330 DAYS
Year 4 is 14 JUL 2012 to 15 JUL 2013 169 DAYS
Year 5 is 14 JUL 2011 to 15 JUL 2012 XXXXXX

PLS ANY ONE HELP ME….?

I do not see anyway you can justify 330 days of leaves .. Let the seniors advise though.

look my case is..
i get married in 14 of july 2011 i have been issue if my residence card in 13 of june 2012.
so my ABSENCE was from
28 dez 2012 to 11 april 2013
10 of may 2013 to 15 of 2014
but been paying taxs for all gaps and wife was here working as well...

Any advise pls? :? :?

For my ILR in 2016…
Im on residence card now going to apply june next year

ABSENCES:

DEZ 2012 TO APRIL 2013
MAY 2013 TO JUNE 2014

On what basis are you applying for ILR (which is under the UK Immigration rules)?

Do you have retained rights of residence yet or do you still have to apply for it?

As you are under EU rules, it is Permanent Residence (PR) not ILR.

PR is under the EEA/EU rules, which you seem to fall under as your spouse was an EU citizen and which is why you can apply for retaining rights of residence.

ILR (indefinite leave to remain) is the same as PR but for people in the UK under the UK immigration rules, not EEA/EU.

There is a massive cost difference between the two, with ILR costing £1,500 at present and PR substantially less and under £100 I think.

I will move your topic/thread to the EEA forum where you will get a better response to your questions. I cannot answer your question on your absences in terms of retaining your rights of residence or PR applications.

The 330 days absence is very significant, and will cause significant difficulties if you wish to secure Permanent Residence.
