Need help Eea Fm app

Post by wish_uk » Sun Aug 07, 2016 11:50 pm

Hi i need some help in following sections,
1- do I need to provide information of my biometrics which I gave in my home country for Tier 4 visa,
2- my spouse have two kids under 21 from previous marriage , Is that fine if I only make two copies of section 6 and pay fees for them?
3- as we have moved from Hungary and I have Residence card issued in Hungary, do I still need to provide evidence of our relationship i.e photos, same address etc
4- Do we need to send divorce certificate of my sponser's last marriage.
5- do we need to attach any court order which shows that mother has right to take kids with her, as both of children are living with mom,
Obviously kids are not living with both of parents, in case 'No' we need to provide proof that children have legal right to live with their mom, (confused)
6- my sponser still working on temporary Ni number is there any problem if we send our application with out waiting for proper NI no,
7- my sponsor first came to UK 21 March and went back after living 3 days, came back to UK after 3 months on 21 June. Which date should we write to answer the question,' for how long living in UK,

Thanks

1) Yes

2) Yes

3) Reconfirm relationship, address & etc. As per EEA(FM) guidance notes.

4) Not sure. Maybe not as you can show current marriage.

5) Yes.

6) May be prudent to wait. Don't submit temporary number (may cause confusion).
Are you sure you have enough evidence of treaty rights yet?

7) Was first time a just a day/weekend trip or residence?

Sounds like start date is really June.

Spouse/sponsor ideally needs a letter from employer (or job contract) to support status as a worker.

If in UK less than 3 months you need documents from the complete period.
Otherwise documents covering 3 months so, for example 3 months worth of payslips.

You mention spouse and FM application (not EFM) so I assume you are married and with a direct family member dependent.

EEA FM is not a visa.
It depends on current information. Not the past information from previous life.

EEA FM is normally all about your current status in UK and that of your sponsor.

Follow the guidance:
https://www.gov.uk/government/uploads/s ... -04_KP.pdf
thank you so much, this link was really help full to me, I looked at this, I found they ask following evidences to proof relationship.
evidence how u keep n contact.
Section 5: Spouse or civil partner of the sponsor
Evidence of living together with your sponsor
If you and your sponsor are living together, or have previously lived together, please provide evidence of this. We recommend that you send at least 6 items, from 3 different sources. These can be addressed to you jointly or individually, provided they clearly show that you live, or have lived, at the same address.
If you and your sponsor are, or have been, living with relatives or friends, and you do not have any bills or other documents addressed to you, please provide a letter from the relative(s) and/or friend(s) confirming you are/have been living with them.
If you have not been living together (but you’re still married or in a civil partnership), tell us the reasons for this and whether you stayed in contact with each other during this time (see questions 5.9 to 5.10 of the application form), and provide any relevant supporting evidence.
Suitable evidence includes (but is not limited to):
 Letters or other documents from government departments or agencies, for example HM Revenue and Customs, Department for Work and Pensions, DVLA, TV Licensing
 Letters or other documents from your GP, a hospital or other local health service about medical treatments, appointments, home visits or other medical matters
Bank statement letters
 Building society savings books/letters
 Council tax bills or statements
 Electricity and/or gas bills or statements
Water rates bills or statments
 Mortgage statements/agreement
Tenancy agreement(s)
 Telephone bills or statements
 Photographs of you and your sponsor together – for example, on holiday or at a family
celebration

 Evidence of how you have kept in contact with each other during periods in which you have not
lived together – for example, letters, printouts of emails or contact via social media, mobile
phone bills showing you have contacted each other, printouts of Skype (or similar) logs, etc
 Any other relevant evidence.
and we have just highlighted documents to prove that EEA national is exercising treaty right, not 6 items.
Is that enough
do we must need to provide evidences mentioned in this guidance note.
thaks

missing documents

Post by wish_uk » Sun Dec 25, 2016 7:18 pm

dear all,
I am non eu national, my wife is eu citizen, we moved to uk with her two kids of age 16 and 20.
with our application we couldn't send some documents as following.
1-Id card of her daughter. (birth certificate sent)
2-signed section 13 (b) declaration from work place, (job contract, payslips sent instead)
3-court order which proof that kids are allowed to live with mother.

mean while our application is in home office. daughter got married and her husband who is non eu national sent her id card with his FM application.

what you guys think, is it possible that QP application could be refused because of lack of her Id card.

are no 2,3 missing documents are mandatory.

in case if we send now our missing documents, what will be the affect on our application.

sorry if my question is confusing.

thank you guys.

Who is applying for what here?
Has HO been informed of material change (daughter's marriage)?
On what basis has daughter's hubby applied for a RC; sponsored by whom?

1) bc is needed to prove relationship to sponsor.
Id will be needed too, where is it/why not sent?

2) Optional; however as much evidence of work needed as possible to back sponsor's case to be a qualified person.

3) Evidence of mom's parental responsibility/custody required if minors are not your children.

basically we applied for QP & RC
QP for my eu wife
her two kids(under 21, so filled section 6)
RC for me non eu national.

Daughter's Id was not sent because it was need to get married.

daughter is also working so applied as a qualified person, and her hubby applied on her eu sponsor basis. lawyer said she dont need to fill another application form as her application is already in home office.
bc is needed to prove relationship to sponsor
we didnt filled a separate form (QP) for daughter, we filled section 6 for child under age 21.Does, in this case birth certificate is enough in place of her id card as her mother is her sponser in this whole application.

bc = birth certificate

It seems daughter is not applying as a dependent then.
And it seems the minors are EEA nationals.

Each QP should have applied on own form in own right.
Daughter needs to notify that she has since married especially if sponsoring hubby.

sorry my mistake, i edited my last message, but i think it was too late.

I remember we applied her as a dependant but also sent her job contracts and pay slips etc.

what should i do, do we need to withdraw her application and send a new separate application as she need to prove her self a qualified person to sponsor her hubby.

leaving uk while RC application is in Home Office

Post by wish_uk » Sun Jan 01, 2017 8:09 pm

Dear All,

my and my wife's application are under consideration in Home office (RC & QP).
I already have a residence permit issued in Hungary as a family member of Hungarian citizen.
I need to travel urgently to my home country (non eu) to visit my parents.

Is it possible if I can request my passport and Hungarian Residence permit back and I can travel.

what I think is I will leave Uk from Heathrow and come back to Paris and then to Uk.
Is this ok?

EEA nationals do and non EEA in some cases.
Request and wait and see.
But obviously hold off buying tickets, even when passports are returned the timeline varies.

Here's an example of what rightly or wrongly can go wrong:
