Residence Card Refused EEA2

Post by ChristineMM » Mon Mar 17, 2014 6:33 pm

I married a British Citizen on the 7th of January 2012 in Copenhagen whilst I had been living in Germany for 2 years 4 months. I continued living in Germany whilst my husband returned in England because he was in employment. He visited me every fort night in Germany. We applied for a visa to visit him in England and I was denied a visa on grounds the UKBA claimed our marriage is not genuine. I continued to reside in Germany and did not appeal against their decision. My husband resigned his job to come and live with me in Germany in April 2012. We applied for my residence as a spouse of an EU national. We received a Germany Residence Permit and Freedom of Movement. We lived together for 8 months in Germany. We were both working at the same company, we have evidence of this. My husband was encountering issues in England that needed his attention. We then decided to come together in England to deal with these attention seeking issues. We drove from Germany to France and grant entrance at the border and we were granted 6 months stamp on my wife’s passport and were advised to apply for a Residence Card should we stay longer. Unfortunately, we had more pressing issue in England that made us stay in England as my husband would have lost ownership of a house to the council. We lived in England, with no intention to live in England. We applied for Residence Card EEA2 in January 4th 2013. I received a Certificate of Application on the 8th of January 2013 stating the do’s and donts’. One of the dos was permission to work in England. I started looking for jobs , however the employers wanted things like bank account, original passports, National insurance no. Etc. I applied for a National Insurance no. And I was denied one. I reapplied for it again after a month and I was granted one. I applied for jobs timelessly, day and night to no avail. My husband was also seeking to go back in employment as well. We applied for University and I was accepted by one University in May 2013. All this time I was still waiting for the Home Office to respond as they stated in their letter that they would respond within 6 months, in the mean time I should not contact them. In June 2013, my visa stamp expired whilst waiting for the Home to contact me. I wrote them more than 12 letters to ask the progress of my application. I approached the MP Barry Sheerman for help so they respond to them what was the progress. They were told that there is a backlog and are going to expedite the process of my application. I was asked to be patient for a couple of weeks, and then my documents will be returned to me as soon as they are done with them, this was in August 2013. September came by and we decided to request the documents back as we needed them for purpose of Identification in the University. I got my documents back with no explanation or anything. The MP's Office called me to confirm with me this. I relocated towns for the convenience of University last September. When I moved I did let them know by a post that I have moved. They say the decision was not signed for and was sent on the 17th of February and again returned back to them, after 13 months of waiting their decision they the MP's Assistant who in turn told me I have been denied a UK residence. My husband and I are exercising our EU treaty rights, why am I being denied residence?I went to the University for Advise and they advised me to wait for formal denial in writing then appeal. My husband is a European National. Why is England treating us like this? Anyone who knows if it is worth an appeal, I am thinking if I get the denied decision in writing , I can appeal, maybe oral appeal would help? Any advise please!!!

As suggested, wait until you have the wordings of the refusal.

In general, you can appeal, request for reconsideration from the caseworker or reapply (or all of those).

Just a note for next time: you might want to divide your post into paragraphs.

I felt that it was quite difficult to read what you had written simply because it was all together in one big block. To be honest, I didn't bother to finish it. I guess other people might have this issue to.
