So what are the steps for an app under Surinder Singh?

We plan to move back to UK May 2016.
I am a British citizen. Husband in a non-EU member.
We live in EU for 3 years now, Kids attend local schools and we are both in full-time employment.
I will have a job waiting for me in the UK.
So what are the steps to take?
is there a form to fill in while still here? Who so I send it to?
I looked at the visa4UK (family permit) and it is a very long form, not sure that it applies in our case?

I read it through and still have questions:
Is the correct form is really on visa4 UK? the amount of info requested is massive. I am not sure that it applies to Surinder Singh.

Also when filling in the form, they want an address in the UK.
This is of course, something I can not give as we are still in a different country.

Any idea on how to proceed?

Yes it is a generic form for FP applications.
It is used in a lot of circumstances, including yours.

You must be planning to stay somewhere when you get to UK, suggest you find a temporary address & use that.

However its not advisable to book anything before your FP is confirmed.

You might want to submit any of the following documents to provide us with evidence of your accommodation. This information might also be useful in showing us that your sponsor lives in the UK. We advise that you do not make any payments for accommodation, travel and so on until you have received your visa

There want an address to show that the sponsor is in the UK.
However, I (being the BC) is the sponsor.
and we are traveling together.
So what is the solution?

If you are travelling together then leave it blank. Is it an optional field?

Otherwise, as suggested above, find and use some temporary address;
(any address you can: friend or relative's or acquaintance's sofa or ??)

Another question:
My husband is a businessman and had traveled A LOT in the last decade...
Am I REALLY required to enter each and every trip he had had in the last 10 years? Is that correct? This must be insane and I does not make sense (

Would you fill it? we are looking at at least 7-10 trips a YEAR :-0

Unfortunately you cannot negotiate or make deals with the authorities.
They must have reasons for the questions & a bunch of cross-checking & verification checks that have to be made.

Don't forget UK is not in the Schengen zone & UK border control is very close to the heart of the government these days (if it had a heart).

Yes (if foreign, not British), as he is a direct family member and will need a visa (FP) to enter UK.

If you husband has a Residence Card issued by another memberstate, then you may not need the family permit.

How and when did you obtain your own citizenship, and was it before or after the child was born?

Notwithstanding the fact that your son has a foreign passport, he may well be a British , and hence does not need any form of permission to enter the UK.

Who would be best to advise me on whether or not they need fp (husband and son hold a residence card of the eu country).

Here is a question I have not seen a reply for
Does the time a non-EU member lived in the EU (legaly, with his British family) count towards the ILR, in case the family returns to the UK?

In other words:
We (I am British, husband is non-eu member) have been living in an EU country fr 2.5 years.
We plan to move back to the UK.
Once in the UK He will apply for FP/residence card.

I know that it takes 5 years until one can apply for ILR
Are the 2.5 years spent legaly in the EU country count towards that?

No it is not.

He will need 5 years in the UK before he qualifies for PR - permanent residence (ILR is under the UK immigration rules).

OK, I am officially lost

If husband (non-eu citizen) holds a residence card of an EU country.
I hold British citizenship.

We both live in the eu country.

We move back to the UK, presenting the residence card of that third country and he gets "eu family permit" on his passport.

What should he apply for next? UK residence card? Family Permit?

Or would it be better for us to apply for a eea family permit while in third country?

Does your husband hold a residence card of an EU country issued under EU law (Article 10 or 20 of Directive 2004/38/EC) or is it issued under domestic law?

If the former, I believe that, provided he is accompanying you, he does not need a family permit to come to the UK. Once the two of you come to the UK, he applies for a UK Residence Card.

If the latter, I believe that he needs a Family Permit before coming to the UK followed by Residence Card after arrival as above.

I am fiiling in the online form (family permit)

2 questions:

1 - I think there is a bug in the system When filling in more then 20 entries in the @travel@ section, the <add> button disappears.
There is no way to add additional info.
I hope that will not create problems with the app, as the list is not concluded.

the applicant passed an IELTS. is that sufficient?

In https://www.gov.uk/family-permit/apply
it states that one should apply online and from OUTSIDE the UK.

We, however, are applying based on Surinder Singh.
We were hoping to enter the UK and apply once in land.

Is it possible at all or are we supposed to apply from the the eu country we currently live in?
If it is possible, then which forms do we use (I can not use the ones on visa4uk).
