Swiss Residency

Post by Wanderer » Fri Nov 27, 2009 12:14 pm

Rare q from me...

If a person (EU Cit) was to move to CH and they have an non-EU partner, how does that work especially if they are unmarried but do have a durable relationship, duly attested? Can they work?

And, if it possible to gain Swiss citizenship for the non-EU person other than by the normal CH 14 year rule?
An chéad stad eile Stáisiún Uí Chonghaile....

Wanderer, it all depends on the canton where you will be staying. Unmarried partners of EU citizens, as those of Swiss citizens have no automatic right to a residence permit, but depending on the canton involve, you'd either have to proof 2 or 4 years cohabitation. Bare in mind that you'd might have to explain why you can't get married, especially if you have no children. The application will be assessed under swiss national law. If approved your partner will get a swiss residence permit valid for 1 year renewable. With it the partner can look for work but the company that will hire your partner will still have to apply for a work permit on behalf of your partner, which is just a formality really. Once work permit has been approved, your partner can start working.
As for Swiss citizenship. After 12 years of living in switzerland. Only other way is by marriage to a swiss citizen, in which case one can lodge an application for naturalisation after 5 years living in switzerland and being married 3 years to the swiss citizen, or 6 years of marriage if applying from abroad. Currently it is not possible for civil partners to naturalise from abroad after 6 years of being in a civil partnership with a swiss citizen.
Hope this helps.
