28 Days Period and Administrative Review

Post by ishfaqsangra » Thu Aug 20, 2015 10:01 am

1-If someone ,God Forbidden, gets a visa rejection and then he/she applies for Administrative Review and decision remains the same. Will 28 Period starts again or ?

2-I believe he will have an option of re-applying in the same category or change to another allowed category in that 28 day period if it restarts?

3-Those who are unsuccessful in second application,the only option left is Judicial Review?If they do not apply for JR do they have any time period to leave the country before they come over stayer?

Thanks for any Inputs in Advance

@ ishfaqsangra, to answer your questions;

1-If someone ,God Forbidden, gets a visa rejection and then he/she applies for Administrative Review and decision remains the same. Will 28 Period starts again or ?

Ans: If AR uphold the initial refusal decision, then Home Office will issue you with a new refusal letter and your 28days then begins once you receive the new refusal letter.

Meanwhile if the new refusal letter includes a new point of refusal which wasn't included in the initial decision, you then have the option to submit a second and final AR.

2-I believe he will have an option of re-applying in the same category or change to another allowed category in that 28 day period if it restarts?

Ans: Yes

3-Those who are unsuccessful in second application, the only option left is Judicial Review?If they do not apply for JR do they have any time period to leave the country before they come over stayer?

Ans: The time given for leaving UK before becoming an overstayer is usually 28days.
The key to success is knowledge and hardwork, and to have faith.
