5 months short of 10 years

Post by saaj » Fri Apr 01, 2016 1:11 am

Hi all,
I am residing in the UK since Sept 2006. My current visa is well over Sept 2016 but my University have withdrawn me from studies and I have appealed against this decision of university.
If I win the appeal I will be fine but if I loose it then university will report the UKVI and my visa will be curtailed. Could you please guide me what could be my options if my visa gets curtailed? how can I legally spend 4 or 5 months until Sept to file ILR? Many Thanks.

Unless you are planning further studies, this is not a Tier 4 matter. Advise you post your query in the ILR forum.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Now moved.

Yes, but it doesn't mean you have to start a new topic when this one had already been moved early this morning to the ILR forum.

It is sincere opinion to you that you must settle everything with university. Do not fight with them at any circumstances. Similar thing happen with my friend last month. It was clear fault of the University because they gave deadline to pay fee unitil 16th March 2016 (email confirmation). Due to the lack of communication between university internal departments (finance and international student office), international student office reported to the UKVI that student not paid tuition fee (withdrawn their sponsorship). University sent this confirmation to the student via email.

Regarding this me and my friend met with many solicitors (some top names). Majority said you will be in problem although it is their fault. If they not accept then you need to go to court where it may take years to resolve the issue. So right now just say "Yes Sir/Madam". No argument at all. Say to the university that you are absolutely alright.

Simply pay or what ever university is demanding obey that. Just think and decide yourself. You also think that you spent 9 years and 7 months legally then why on the edge going to loose the chance of very good education which is welcomed all around the world. When you will be visa free, I think you will better concentrate on studies and will be more beneficial for British society. At this stage you may save some thing (£) but on the other hand you will be lot more looser.

Please update the out come.

Please confirm to the university that they informed this to the UKVI or not. I believe they already informed, because after informing to the UKVI, international student support office said to the student that you can appeal against this decission which will be dealt with in university (which is OK). But meanwhile UKVI issued you 60 days letter then you must need to apply new visa with new fee and immigration health surcharge. So please keep in mind all these things and decide.

Thanks for the above discussion. University informed UKVI in February then university withdraw this report on the basis that I have filed an appeal against the university decision. Now they are waiting for the outcome of my appeal which I hope will come by mid of April. If by mid of April I loose my appeal then university will report to UKVI again.
If university report to UKVI again, can I switch university by securing place at another university? and if I am unable to secure a place then what are my options?

Thanks for your valuable comments.

Please confirm to the university that how many time you can make appeal. I think it would be twice. In that case you may pass 5 months. :P :P
