Hello,
I am on tier 2 general visa at the moment. I cant apply for ILR based on Tier 2 general because i wont fulfill the salary criteria. I will be 7 months short on my 10 years long residence. Can I switch to Tier 4 to fill the gap? Please let me know if you have any other suggestions.

You could switch to Tier 4 if you can find an institution, or switch to FLR (fp) , them vary for Set (LR). At least by that way, even if set LR is refused , you could get a right of appeal.

Hi...obie I make set (lr) early application n got bio 12th June ..I m sort of ab 6.5 month do u think I will get appeal right or AR...bocos this forum I show many set (o) application tier1 cases...now days they give only AR but I have not seen on set (lr).,.,
I also read guidence for ser (o) and set (lr) ...in set (lr) Ho mention ab appeal right but not in set (o) ...can u explained me plssss any other gurus too

And after bio submit how long Ho take for set(lr) decision ...thanks

Hi All,
I am in a tricky situation too. I last applied for a compassionate leave to remain but has been refused. I came here in 2006 and now I am short of 5 months to complete 10 years lawful stay in the UK. I am now advised to take my case to high court. My compassionate leave to remain application is on private life grounds.
Any idea how long does it normally take for a judicial review.
Will I be able to reach my 10 years if I proceed with the judicial review.
I am really panicking.

If your application has been refused with no right of appeal you don't carry on accumulating lawful leave. You won't get to 10 years.

Hi I read a case published in upper tribunal decisions. about a russian girl came at the age of 21, had 9 years of legal status, and applied for leave to remain outside the rules.
Home office refused first, but she won the consecutive 2 appeals, in FtT and UtT.
I have the case number, not sure if it will be any use for you to reference in your case.

IA/14008/2013

The case was determined on Oct 2014. And she was able to demonstrate that she has no ties with Russia due to the length of time she has stayed here with her families.
