It might be easier if your friend posted so that he can explain his circumstances.

Wife should not be working, she is not allowed to.

How old are the children? Where were they born?

No, the brother cannot apply for anything for the children because they have the same surname. I am really hoping that you are not looking for a way that the brother can try to do an application for them claiming the children are his?

No he can't.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

The UK does not entertain informal adoption &/or 'gifting' of children amongst family members.
