Extension of discretionary leave

Hi am new on here..I need help with my application extension for DL. Am married to a British and have 3 kids together. Am not sure what form to use to extend my visa..my letter says" although you do not qualify for LR under the immigration rules..it has been decided that discretion should be exercised". I would like to know what form to fill. And my husband has recently lost his job, will that affect anything..I am extremely panicking as my visa ends mid June..

I take it the leave was granted in June 2011?

What was the application you applied for before the DLR, was it FLR(M) that was rejected?

Hi Amber I think it was the FLR(M) that was rejected..was facing removal and all. So made fresh application with FLR(O) and was expecting the third child at the time and was granted..

Yes it was granted in June 2011

Then apply for FLR(O) before current leave expires. It should be granted again if circumstances are the same.

Will my husband's unemployment status affect my application ? Am currently going to college part time as my lil one is 3 years of age. What points should I put on my cover letter as am not good with words. I used a solicitor for my last application as it was funded for, am really stuck. What's the soonest time to apply?

You should apply from 28 days before your current leave expires.

Employment or lack of isn't an issue, you can also claim benefits. Write a cover letter explaining your life is in the UK, it's your home and your child is settled here. Just write about what makes the UK the centre of your life. That should suffice.

Thank you so much..that has really helped..will keep you posted.. Has any forms changed for 2014 because I called up a firm today and they were telling that I might have to apply on a different form not the FLR(O)?

No the FLR(FP) form is not for DLR. Many people are mistaking it.

FLR(FP) is for leave granted under family/private life provisions which are either a 5 or 10 year route settlement.

FLR(O) is for other applications of which DLR is as it no longer exists for new applicants.

No, they'll write to you and invite you to go to a participating Post Office to complete Biometric enrolment.

You can't apply at a PEO for an extension of DLR!

You should stipulate in the form, that it's an extension and the same circumstances as your previous application. What do you want bank statements for?

I don't know what you are on about, you can send a FLR(O) DLR extension only by post, before your current leave expires, sending via 1st class recorded delivery postage and keeping proof of postage.

There is no Financial Requirement for DLR, so I don't know why you keep going on about bank statements?

on the checklist form for FLR(O) says bankstatements...shouldnt that be provided
