ILE expiry date and ILR for returning resident

Post by Nath44o4 » Tue May 26, 2015 12:52 pm

Hi
My wife and I have been living in Australia for the past seven years, however my mother in law is now ill and we would like to return to the UK to provide care.
My first application for a returning resident visa was rejected, at which stage I started a Masters, on appeal, it was approved. My Masters is now complete, but there is only three months left on my Indefinite leave to enter visa.
Can anyone tell me the process on entering the UK? Does the returning resident visa and indefinite leave to enter means on entry I automatically get my ILR, or do I need to apply again, and what are the criteria for obtaining an ILR given I have a returning resident visa?

My worst case scenario is we pack everything up, head back and in three months time I'm told I need to apply for an ILR visa, but don't qualify because I haven't been in the country for two years.

If you are admitted as a returning resident, then you should be fine.
