Mother's Visitor Visa - Refused Twice

Hi All,

I need help with regards to my Mother's Visitor Visa, refused twice on basis of following:-

lack of financial, social ties with the country.

Application 1
I had applied visa for her in Jan 2014 which was for both my parents. The docs which were submitted were following:-

1) property papers on name of my father
2) 6 months bank statements(amount in which was not more than Rs. 50000(£500))
3) My bank Statements for 6 months with an average around £20k
4) My Employers letter confirming my employment
5) Letter from Letting Agent Confirming he is happy for my Parents to stay with me.

I was on Tier 2 General at this moment. The visa was rejected on grounds of lack of financial, social ties with the country. At this point we had not shown that they also have another son, my elder brother with whom we do not have good relations.

Application 2
Second application was submitted in Oct. 2014 from my mother alone as my Dad passed away in Jul 2014. The docs which were submitted were following:-

1) property papers on name of my father as we could not get it transferred since my brother is not in an agreement and my father did not have a will.
2) 6 months bank statements(amount in which was not more than Rs. 25000(£250))
3) My bank Statements for 6 months with an average around £20k
4) My Employers letter confirming my employment
5) Letter from Letting Agent Confirming he is happy for my Mother to stay with me.

This time we applied hoping that UKBA would be considerate but unfortunately is was a wrong choice.
I was still on Tier 2 General at this moment. The visa was rejected again on grounds of lack of financial, social ties with the country.

Having seen 2 rejections and then going through multiple post on these forum I decided to wait for more than an year so that I can build a financial back ground for my mother in India and I can also attain ILR.

I had opened an account for her in Jan’ 15 depositing all my India balance into her account and has been paying electricity bill and mobile via it online. Also now she has FD’s of around Rs. 26,00,000(£26K) from which interest of around Rs. 16000/month is paid into her account as a monthly income. Also she has a health insurance of around Rs. 5,00,000(£5k) + Life insurance of around Rs. 10,00,000(£10k) for which annual premium is Rs. 1,00,000 & she has already paid 1 premium and would pay another 1 by the time her Visa application would be submitted.

My mother has 2 sisters and 1 brother from whom I have got copy of PAN card’s which shows name of my Grandfather so suggesting she has siblings in India.

I am on ILR now and my Mrs. also has an ILR. We have twins for whom British citizen application has been submitted.

Can you please confirm if now her Visa application is likely to be accepted? I am still maintaining similar UK balance as earlier and can get letters from my employer and Letting agent. Problem is House in India is still on my Father’s name since my brother is not ready to talk about it. I have for a legal Heir Certificate from local Tahsildar office stating 3 of us i.e. my mother, brother & me are legal heirs.

Also her Visa has been rejected on Para 41 (1)(2) of HC 395 on both occasions.

I think the reason you've had no answers is that no-one knows. It's up to the Entry Clearance Officer's judgment.

What you've done is great, makes it less likely that it will be refused but we just can't tell how much less likely, sorry!

Thanks avjones. I have some specific queries if you or one of the seniors can kindly answer :-

1) is it ok to have Fixed Deposit or Liquid Cash is required in saving accounts? what should be average balance in saving accounts on monthly basis for one person travelling i.e. like around Rs. 7,00,000 would be good enough?

2) Property in India - Is the property in India a definite requirement or as in my mother's case a shared property would be ok?

1. Fixed deposit will not be considered. Funds must be liquid.

2. Should be ok, not 100% sure.
