Child born in UK, which visa to apply from outside UK?

Child born in UK, which visa to apply from outside UK?

Hi all,

When my daughter was born in UK, my wife and me were on Tier-1 FLR. I didn't take any visa for my child due to time constraints when my wife left along with my daughter to India on her maternity leave.

I thought of doing "register as British citizen" after we have got our ILRs, but I read in one big thread here that it takes upto 6 months to get which I wasn't aware of it. My wife came back to UK couple of weeks ago to apply ILR and y'day we have just been granted ILR at Croydon centre.

Now, I think I should apply for my child on "child of settled person" category but it looks bit complicated than Tier-1 dependent visa, so I'm just wondering can I apply Tier-1 dependent visa to bring her UK or is there any other visa I have in my case to speed-up, we want to bring our daughter asap? Once she is here, I plan to immediately apply register as British citizen.

Any help would be highly appreciated as I going to India in 2 weeks to submit my child visa application. Is the "child of settled person" is the only option I have got for my daughter in my case? Thanks in advance!

Has your child held a Tier 1 dep visa before leaving the UK?

Hi,

No, she only has Indian passport and birth certificate given in London. I came to know about this 6 month long processing times of "register as British citizen" only after she left UK, it's my stupidity in assuming that I will be granted that in few weeks time.

Not all applications take that long, however, the child also has to enroll biometrics so that will complicate things slightly. Passport applications from India take 6-12 months.

Child settlement visa or ILE is the best one to go for.

Ok thanks a lot, that's what I thought too, hopefully we get it soon. Is ILE different from Child settlement visa in my case? I will study these visas further this weekend, thanks again!

Same/similar visa, ILE is indefinite leave to enter, so ILR application will not be required, as far as I understand, at a later date.

Ok, thanks a lot and I shall refer the link. However, once she is back to UK, I plan to register her as British citizen immediately, so shouldn't be a problem with either visa for my purpose.

As I understand it, ILE/ILR is the same visa. ILE is issued to people outside the UK, while ILR is issued within the UK.

@CR001, sorry to come back on this, as I'd already specified in initial post that we both are in ILR and daughter born in UK, in that case should I complete VAF4A APPENDIX 1 or 2 along with Form SU07/12? I have completed the online application already and now need to fill-in these docs.

I spent couple of hours on this forum today but still couldn't conclude whether I need to fill-in Appendix 1 or 2? Some guys filled-in Appendix 1 and some Appendix 2, could you pls confirm this? Many thanks!
