I am dependent of student who is British national overseas BN(O)without any citizenship and eligible to apply for full British citizenship under new immigration rule effective from 13 January 10.

what is the best advise for dependent who is living together for more then 7 years to apply for ILR OR CITIZENSHIP.

1. Is any way the dependent apply at the same time with the main applicant?
2. If not ,once the main applicant got his Full British citizenship passport then apply for settlement visa and apply for ILR after 3 years then full british citizenship?

What is best advisable?

Ethnic origin of Hong Kong holding BN(O) passport are the British National overseas without any citizenship.


Registration as a British citizen for Stateless BN(O) is now available

Let me clarify my question in this forum:

Main Applicant:

Passport: British national (overseas)
Citizenship: None( Ethnic origin of Hong Kong)
Place of Birth: Hong kong

Current Status: Student in U.K since 2003

Application for Extension of student visa: The application sent back to me the reason is " Invalid photograph" Time given to re-apply 28 days.

Border citizenship and nationality law: from 13/01/10 I am eligible to upgrade my citizenship by using B(OS) form available from UK Border Agency.

My dependent: My spouse who is dependent on a me(dependent of a student) living together since 2003.

Action:

1. I am re-applying my application with my spouse for leave to remain as a student to regularise our stay. At the same time I am using Nationality checking service to apply for British Citizenship by using B(OS) form.


Advise for following issue:

1. If our application under Tier-4 application rejected what impact will be on my dependent?

2.Is any other way my dependent spouse can apply for British Citizenship at the same time with my application?

3. Can my dependent apply for Nautralization once I got my Citizenship?

I thought only BNO's from HK of other than Chinese ethnicity are considered stateless, but I'm no expert, suggest u repost in the ILR or BC section.
