Dependent visa of ILR

Post by freakychin2016 » Mon Dec 05, 2016 6:18 pm

Hi,
I have recently granted ILR(Long term residency) 10 years route. My wife joined me in 2009 and she is still on her dependent Visa( student. I wanted to find out what is the best way and which form do I have to use to apply for her new Dependent visa and what are the requirements.

Thank you in Advance

Give us a timeline of what visas (and periods) you have been on and what visas (and their periods) your wife has been on. We can then advise you better.

She has no other option but to apply to switch to FLR(M) - spouse settlement visa.

Dependents of ILR Long Residence Applicant (click)

She needs English A1 (before May 2017, A2 from May). You need to meet the financial requirement of £18,600pa (more if you have non British children).

Dependent visa of ILR

Post by freakychin2016 » Mon Dec 05, 2016 9:13 pm

Thank you for prompt response everyone.
I will provide further details below:

My timeline
I arrived in UK December 30 2006.
My wife arrived February 9th 2009
I have granted ILR 2nd of December 2016.
I also have 2 kids( 4 months old) and I believe I can apply their British Passport now by filling MN1 form.

My wife's current visa expires on January 2017.

I am thinking to apply children's passport 1st so I don't have to show additional funds when I apply for my wife's Dependent visa.

Also, does my wife's income count towards her Dependent visa
or is it only my income has to be £18,600/Year.

what is the best method to apply for her dependent visa( if many options available I am looking for easiest :D )

Thanks in advance.

My wife's current visa expires on January 2017. She will need to apply on FLR(M) before her visa expires.

I am thinking to apply children's passport 1st so I don't have to show additional funds when I apply for my wife's Dependent visa. You won't get MN1 Citizenship approval before January 2017. BC applications take a few months.

Also, does my wife's income count towards her Dependent visa Yes, her income can be used alone or combined with yours. You will likely need to prove income of £24,800pa
or is it only my income has to be £18,600/Year.

what is the best method to apply for her dependent visa( if many options available I am looking for easiest Two options only, postal or in person.:D )

Hi CR001
Really Appreciate your Prompt Reply.

Our Kids were born in UK. what happens after
MN1 approval , do I have to send another forms to get their British passport done?

I was checking FLR(M) form and I have seen that I can show my saving as well to support the application( ccan i use my saving as support?). we do have combine income which goes over 25K however she is on maternity does this count?

Thank you again in Advance

Once British, only then can they be issued a passport, separate form with its own application fee. You can apply for the joint citizenship and passport scheme offered through NCS (nationality checking service) at the council (small fee payable to use this service).

I was checking FLR(M) form and I have seen that I can show my saving as well to support the application( ccan i use my saving as support?). we do have combine income which goes over 25K however she is on maternity does this count? How much are your savings? Both incomes are find and maternity should not be a problem provided she has proof of her ongoing job.

Hi Again,
I have started filling MN1 form but I am stuck right at the beginning with this question " Please indicate the section of the British Nationality Act 1981 under which you would like the application considered. See Chapter 2 of the guide for details "

My children were born when I was on Student visa so I am not sure what to fill in.

Help Needed.

Thank you

If children are UK born, the it is section 1(3) of the BNA.

Dependent visa of ILR

Post by freakychin2016 » Tue Dec 06, 2016 9:38 pm

Last piece of information required

I am using section 1(3). and stuck here on some of the questions:

1.9 Present Nationality- what shall I fill here as they never had any nationality obtained
3.1 Please say which parent is the one who is a British citizen by descent and on whom this application is based.

Do I have to fill section 3 at all?

Thank you again in Advance

1.9 The child assumes your nationality. Child is not stateless.

Section 3 is not applicable to you.

Have you decided whether you want to change your user name (which you have requested) or your account to be deactivated (meaning you won't have access to the forum) :?:

Post by freakychin2016 » Fri Jan 20, 2017 8:10 pm

Hi
I am trying to fill the FLR(M) form but Stuck on few points here. is there any chance I can get some help?
I will provide some background:
I have applied for my kid's Naturalisation via MN1 but still waiting for reply. My wife's current visa expires on 30th of January.

I need help with these

Page 11- Which point should I choose from question 2.1 and 2.2?

Page 28 Question 7.3 Do I have to tick on Income from salaried employment ?
If yes then which Category should I choose A or B? or shall I leave it blank?

I am confuse about main applicant's earning as she is on maternity from last August will her income will count as I am only on 18K and I was planning to combine her income
in order to meet financial requirements.

Do I have to Fill page Maintenance section?

Thank you in Advance.
