Hi,
Just wanted to make all affected aware that a Parliamentary inquiry has been launched to explore the impact these new rules are having on family migration including that on elderly dependents.
It would be extremely useful if all affected could share their views on -

Hi there,
I want to apply for Dependent visa (outside UK) for my parents both alive and together and over 65 and financially dependent on us. Seems immigration law favors only widowed or single parents…!

My brother and I both have ILR/British Nationality. We are well settle, earning £65000+ per annum; I owned a 3 bed property and living alone. My parents does not have anybody particularly to look after them in their country, they used to have another unmarried brother who used to look after them, but now he is moving to China for business.
We send money to them regularly via bank and cash and have records of bank transaction. In this situation is there any possible way that we can apply dependent visa for my parents? Should we apply from outside UK or within UK as they are visiting us in Mar hopefully.

Hi Zaman, You would need to make the application from outside the UK. You need to show that your parents are unable to do basic tasks such as cooking, dressing themselves etc. Please see link below for further details

But they can do basic things in life it just they are on their own and financially dependent on us and that’s why we want them to be here.
Is this same as indefinite leave to enter - - ILT?

They changed the rules on the 9th of July 2012 to make it harder for elderly parents to settle here. Now you have to prove that they are unable to look after themselves, that the correct care is not available in your home country even if you were to pay for it etc. I would go to see a solicitor. But if they are only financially dependent on you they wil not be able to apply just on that basis.

Hi.
my mother is 58 and recently widowed . i am a settled person in UK and got my own house .i have one younger brother aged 20 in pak living with my mum but he is in full time studies at uni.my mum already got a 5 years family visit visa. can i apply for her permanent stay ?is there any age restrictions?and what documents do i need?can any body please guide me with the latest immigration changes.

I was listening to the mp3 podcast attached to the family migration post here:

At one point a lawyer giving evidence said that
if elderly dependents failed to obtain visa under the new inhumane rules, they would be ineligible to apply under the family visitor route, leaving them no way to come and visit their family. Can anyone else confirm this?
Also does the reverse rule apply? That if an elderly dependent has been granted a family visitor visa, they can no longer apply and be granted ILR under the new rules.
It is interesting to note that only one successful application has been made for an elderly dependent under the new rules. Again stated in the above linked podcast. Worth listening to if you haven't already.

Your status determines which relatives (or future relatives) may be eligible to receive immigration benefits.

Dimension7 - the reason for what the lawyer said is basically that ...
If you apply for a settlement visa, you are showing you have few ties to your home country and want to move somewhere else.
If you apply for a visitor visa, you are showing you have strong ties and will return home.
So applying for the settlement visa naturally says 'if I apply for a visitor visa - I'm likely to stay' - and you have to provide some pretty strong proof that you're not. Hence why it's regarded as a 'not likely to be successful' situation.

Hi All,
I have ILR visa and have applied for citizenship in February 2013. My mother is widow and 66 years old. She is diabetic and has high blood pressure as well. My all three sisters are married and live with their families. My elder brother who used to live with my mum, has now settled in USA. So, my mum is alone in Pakistan. My wife got ILR in 2012 and I sent her back to Pakistan to take care of my mum and I try to visit them twice a year.
My mum visited me in UK twice (2009 and 2011) on 6 months visit visas. Now I intend to apply dependent visa for her so that she comes here permanently and I can take better care of her once she is here and my wife would also be here to take care of her.
I want to know if there are any chances of getting the dependent visa for her and if yes, then what documents I should attach with the application.
Thanks in advance for your advice and sharing your experience.

Thanks for the link. One option seems for now, is to apply for family visitors visa for two years as she already has visited UK twice on 6 months visa each time.
Being optimistic, after getting two years multiple visa, we can wait for any relaxation or amendment to be made by the government in the dependent visa category for parents. IF this happens then we can go for dependent visa at some later stage.
Please comment.

Yes good idea if you can prove she is independent enough to want go back. I'd apply asap for visitor visa because once the Crime & Courts bill is passed family visitors will no longer have appeal rights if visa refused.

Frankly I am not sure these rules will change. As indicated in the reply to this letter
The reply sums up the government attitude.
"Regrettably this is a subject area where the Government is not very interested in listening."

Thanks for your reply.
I am going to apply two years family visitor's visa for her, hopefully in a couple of weeks time. The documents I am planning to attach with the VAF1B form are:
1. Sponsorship letter
2. Sponsorship declaration
3. Last three months payslips
4. Last three months bank statement
5. Home Registry as a proof of accommodation
6. Copy of my passport
Please suggest if any other documents also required. One problem is that I am going to be made redundant from 12th of April and I am going to start a new job from 15th of April. Should I send three months payslips of my current employer and the contract letter from the new employer?

Hiya,
My sister came on a visitor's visa as the rest of the family lives here.However,my parents decided to apply for a ILR (adult dependant) through a solicitor who charged them over £4000 for fast-tracking the visa.honestly,I feel its too much money and the solicitor claimed the case is straightforward.I'm a bit skeptical though want things to work out at the end.
Could someone share any info,if they have been in a similar situation and what are the rules??

Did your parents apply under old rules (pre July 9th 2012) or under new rules. Either case there is no fast track and this is one of the complex category.
We made an application and been waiting for nearly 10 months now.
