Hi All,

@Pak86 kindly read links of page 4 or 5 of this thread you'll find out about my whole life story for the refusal. I know that its a lot more complex than yours but still a refusal is a refusal. Yes the deadline notice is a review stage but if it fails in review it'll take another 6 months to go to the court to get the final decisions or the final verdict on your appeal case. From the appeal application to the review it took nearly 5 months or so already check my timeline or other timelines and you can figure it out by your self ,and God Forbid if you didn't get the visa in the review stage, you are looking for another 6 months after the review deadline so that will add up to almost an year time before your whole appeal thing is sorted.

@asif_sharif there's no way of checking the progress of your appeal. if you gets your review date this means that your appeal is in progress. other wise there's no other way at all in way shape of form to check the progress of your whole appeal process step by step. I know its a very sad dilemma but unfortunately that's how it is.

Again a humble request from every member please remember me in your prayers and I'll also do the same for every member.

Kindly keep us updated on the form regarding your appeals review deadlines.

just called them said there's no update as of yet maybe another week and a half application been sent to embassy and might not ever get to court if the embassy ur appeal and agree. he said that as there are lot of appeals to go court we stagger them. thats why sometime so are slow the gentleman even agreed with me that should be a system in place at least to get a rough time of when you get ur court date.

if it doesn't go to court do i get £140 back :?:

@stillwaiting123 have you heard any thing back from the FTT regarding your application review ????

I just wanted to ask if any one can tell me what the paragraph below means it says on the review notice I've received from the FTT

To the Respondent
"A Notice of Appeal was lodged on 26 June 2015 against the respondent. A Copy of the notice of appeal is enclosed.

The Tribunals directs the respondent to send copies of all the documents to the Tribunal and to the other party, to include a copy of the notice of decision to which the notice of appeal relates, and any other documents provided to the appellant giving reasons for that decision, together with any statement of evidence, application form, record of interview, or any other unpublished documents on which you rely, to arrive within 28 days of the date on which you received from the Tribunal a copy of the notice of appeal and any accompanying documents "

I am confused about the above paragraph. I would like the respected group members/experts/gurus to help me in understanding the above paragraph.

One of our family friend lodged appeal on 01/04/15
And review date is 27th August
He called on that no 0113..but they are saying we didn't get any document about court hearing so there is no decision yet.

He also ring on paid number to esclate but they said we don't deal with appeals etc

It's just 2 more days left and lot of other people who lodge appeals after him got either court date or got call to submit passport

What should he do any suggestion? What's likley the reason

Hi Tehmina,

First of all thanks a lot for sharing such a precious experience here with us on the forum with the members. Cause many of us are in dark/confusion about review date deadlines. It doesn't happen very often that UKVI will reconsider the case within the review dead lines, at least not many ones in my knowledge. it goes to the court 90 % of the times.

Well that's a very sad dilemma about appeals, according to my lawyers/representative UKVI being UKVI they don't normally send documents if they think that their decisions is wrong to the courts and then when the review deadline gone past the FTT will decide a date for the court hearing and just inform the UKVI about it and it happens quite often that UKVI don't send their representative in those cases in which they knew that they have got very slim chances to win for their decisions and then the court decides themselves either by ordering UKVI to issue the visa or ordering the appellant that sorry but UKVI is right at their place in refusing the visa.

So I think there's nothing much your relative can do at this point of time apart from praying hard for the visa appeal.

In my opinions its going to court...if they was going to overturn decision they would have by now

What's your deadline bro? And I should hope so but if they just hurry up and issue the visa I can live without it haha

Hi March2015,

you are absolutely right those were the exact words of my lawyers/representative as well. he also said that they rarely issue visa in the review deadlines. so any body hoping to get a reply from UKVI in the review, the chances are very slim for that. I know that's sad but that's how it is. I think its contempt of court as well but don't know why the Government didn't get charged for that. if I dis obey a court order I'll get arrested the next second. but the Government doesn't really have to face any consequences of even disobeying court orders and clearly ignoring them.

My lawyer said that in 99% of the cases which goes to the appeals the success rate is 99% just because of the reason that the UKVI hasn't got any proofs to back their refusal decision and in the end they have to issue the visa. I just wish that they bring the law that UKVI has to pick up the legal fees of both sides as well I wish I'll hammer them with at least good £10 to £30 K pounds just in legal cost.

People don't be so glum I personally know my friend who was given his visa in the appeal process within a month or two of his appeal and he didn't even meet the financial requirement.

His chances were very slim but alhamdulilah he got the visa, all this about there is little hope etc is nonsence there only decision maker is Allah so put your faith in his hands as Allah knows best and if you know someone going hajj as them for duas

Hi All,

I do really apologies I didn't mean to disheartened any body at all from my post.

Its just that I haven't met any one who got the visa in the review stage and later got it on the date of actual hearing and I am not saying this at all these are the words of my lawyer/representative who deals with appeals cases every day so he was sharing his own personal experience with me. I didn't mean to any one to loose hope at all.

Even I still remember my X wife case back in the year 2010, I haven't heard any thing back in the review deadline period and even at that time I got the Visa on the Actual hearing date.

Well I am hoping and keeping Faith on Almighty Allah that Insha Allah Allah will help all of us Insha Allah in getting the visa in review stage Insha Allah AAMIN.

Remember me in your prayers and I'll also remember every one in my prayers.

Have you really spent £10,000+ on legal fees? It's sooooooooooo much! I don't think it'll be £30,000 that's crazy.

Spouse Visa (Entry Clearance) granted on 20-02-15
FLR-M (Extension) granted on 24-08-17
ILR (SET-M) not due until 2020

Hi i.need.help

When you make a claim you don't claim for the Original amount spent you need to add personal damages and legal compensations to the amount claim as well.

Have you ever made a personal damage claims in the court if not then you need to get knowledge around this area first that how you make the claim.

I don't think that any body would have asked such a "stupid" question what you have asked and I never said in my post that I have spent that much on the legal fees. I just have said that I wish I can hammer UKVI for the amounts. Just a good piece of advice think before you are asking any thing read my post carefully and I never ever said that I've spent these amounts.

I don't mind really and I don't really care if you don't reply to my post but I do take this in to serious consideration that when some one reply for my post must have read it carefully before pointing their fingers at me.
