Please help urgent matter

Post by kidraja » Sun Jan 01, 2017 8:30 pm

Hi

I hope someone can help me on this urgent matter.

My wife received her visa last month (December 2016) and arrived in the UK on 26th December 2016.

Its only been 6 days in the UK and she made lies up to her brother that I'm treating her like a slave and don't want her to call or see anyone. She took her passport and all her belongings and left with her brother.

I've been scammed...

I called the police and they cant do anything since its not "domestic violence". I kept the call record for calling the police.

What shall I do ????

I'm worried she might try to make something up with the police to get me in trouble.

Please help...

You are required to notify the UKVI that your relationship is no longer subsisting and your wife has left you by submitting the form in the link below.

Sorry Casa

I'm really confused a lot at the moment.

There are two forms, which one shall I use ? do I post or email to Sheffield office ?

Can she cause trouble with anything I own, such as property? (I owned it before I got married to her).

What about if she makes a "domestic violence" case for get stay ?

I've done nothing wrong

Most unfortunate case.

In this country, nothing can happen without investigation and evidence.

Once it has been reported, your wife's future is out of your hands and in hands of UKVI.

As to personal matters (non immigration), you may wish to seek your own legal advice.

You need to complete both forms.

I suggest that you send them to the following address. I'm sure it will reach the appropriate department.
Immigration Enforcement
1st Floor Seacole
2 Marsham Street
London
SW1P 4DF

Regarding marital entitlements (if any), contact a solicitor who specialises in family law.

It could either be pre-planned or maybe some confusion. I won't suggest to straightaway immediately report to HO if the tension can be fixed informally usually through back home families. In my point of view the sponsor shouldn't sponsor the foreign wife from abroad soon after the marriage rather take some after marriage to decide that whether is it worth to sponsor her. I wish you overcome your problem positively otherwise you may have to suffer again from financial loss on divorce cost soon after the heavy cost of spouse visa.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

This is an immigration forum and as such, advice regarding 'financial loss on divorce cost' is inappropriate.

Your prompt assumption is incorrect as the OP is advised better to not be hurry in informing HO because it could be a mere confusion which can be fixed otherwise spouse visa cost and divorce cost may be seem heavier to afford. So better to fix the issue first.

"Brother" or worse, the honeymoon is over, its a civil matter now:
Its only been 6 days in the UK and she made lies up to her brother that I'm treating her like a slave and don't want her to call or see anyone. She took her passport and all her belongings and left with her brother.

Didn't sponsor spouse straightaway, been married since April 2015.

Spouse attitude changed after coming here, was supporting her in everyway since she came. I knew it would take time to settle due to big changes.

Her brother was threatening me not to contact HO or solicitor. So it was all pre-planned.

Is relationship over or she still your wife?

I mean if relationship still exist then they may not deport her

You dont need to worry as she cannot do anything if you have not done anything wrong to her

I will say the relationship is over now.

She walked out with her passport and belongings with her bother.

Her brother threatening me not to inform HO or solicitor.

But I tried to inform the police what happened, but they can't do anything since it was not "domestic violence" involved. They did say that call is filed with them and I kept screenshot of calling them.

I emailed HO through "public enquires" and my solicitor about what happened.

You've misunderstood the significance of a relationship which is no longer subsisting as far as the UKVI are concerned. If the wife has left and is no longer living with the husband her spouse visa is no longer valid.

This is why the husband is required to notify the UKVI of the change in circumstances by submitting the forms which are found in the link I posted.

An email to 'public enquiries' is unlikely to get any response. You need to complete and send both of the forms I've posted in the link.

That's something you'll need to discuss with a family lawyer. Your local CAB may be able to give you some basic free advice in the meantime.

As a matter of interest, did your wife collect her BRP when she arrived in the UK?

You appear to be completely shell-shocked; that is understandable and normal.

However you need to get back into the driving seat - with support of family, friends and guidance from appropriate professional advisors.

No not yet...

It's was down to collect on 2nd January, but since it's bank holiday today, post office is closed. They will try from tomorrow onwards.

Nothing. No one will be aware of the change in circumstances.

As you are British national and it's your homeland now and you won't be deprived of what you deserved if follow the right path. Try to become brave and recognize the strength of your status and also address the consequences to your partner and her brother. Try to record the threats you receiving.

Its common to have misunderstanding between partners so wanted to make sure if this relationship is over from boht side before he actually rush towards reporting

It's permanently over..

Herself and her brother making lies up to family that I kicked her out.

Why would I waste £4000 to get her here and then get rid of her ?

Btw...

I've posted the two forms (relationship not subsisting) with a letter explaining why 2 days ago.
