Quick Question: Dependant Category A or Category B

Post by NeedAdvicePlease » Wed May 14, 2014 3:17 pm

Hello all,

Background:

- I just got ILR based on 10 years.
- before getting the ILR I was on a tier 2 general visa since July 2009.
- My wife is on a tier 2 PBS dependant visa since July 2009. Her current visa expires on July 2015. She has been in the UK for nearly 5 years.

Questions:

1. Given that I have just got ILR (10 years), does she has to switch to FLR(M) or can she contiune to stay on her current visa (tier 2 PBS dependant) ?

2. If she has to move to FLR(M), which category applies to her i.e. Category A or Category B ?

Many thanks!

Thanks to your quick response Amber but I am afraid I do not understand what you mean by "Section 7A and A1 English a 5 year route to settlement"? Does my wife need to switch to FLR(M)? If yes, which category (A or B) please?

Once again, thanks for your quick response!

What I meant by Category A and Category B is:

In the FLR(M) form, one of the questions is about Category A (two year route) and Category B (five year route). So my question:

Given that my wife has been on a tier 2 PBS dependant visa before the 09-Jul-12 changes can she go with the two year route i.e. Category A?

Or does she has to go with the 5 year route because I got ILR after the 09-Jul-12 changes?

Many thanks.
