Switch from 10 years category to 5 years Category

Post by musheash » Wed Oct 08, 2014 8:25 pm

Hello

I am British citizen. My partner has got her limited leave to remain on the basis of private life within the Immigration Rules under 276BE. She has got 30 months visa starting from Aug this year. She will have to follow 10 years route for settlement. I was wondering if she could switch from 10 years route to 5 years route of Unmarried partner visa. If yes will she has to meet minimum incom threshold ,when i received carer's allowance for taking care of my father?

Secondly she has three kids (5-6-7) who will apply with her. She is full time employed and earn 18000 a year. I am not working i take care of my father. I would appreciate if someone could help us in this case.

Provides she passes her English language test or is exempted from it, and you are able to prove unmarried partner relationship and show there is adequate accommodation, i believe your application should succeed.

The 18000 is more than sufficient earning to demonstrate that you have sufficient resource not to be a burden on the UK's resources.

HI,

I WOULD APPRECIATE IF SOMEONE CAN HELP ME WITH THE LIST OF DOCUMENTS NEEDED TO APPLY FOR UNMARRIED PARTNER VISA.APPLICANT HAS THREE CHILDREN,WHO WILL BE INCLUDED IN THE APPLICATION. PARTNER OF THE APPLICANT IS RECEIVING CARER,S ALLOWANCE FOR TAKING CARE OF HIS FATHER. APPLICANT HAS 30 MONTHS LEAVE TO REMAIN UNDER PRIVATE LIFE CATEGORY. SHE APPLIED ON 7 JULY 2012 FOR DISCRETIONARY LEAVE TO REMAIN SINCE SHE WAS LIVING WITH A BRITISH PARTNER BUT IT HAD ONLY BEEN ONE YEAR SINCE SHE WAS IN RELATIONSHIP. SHE DID NOT HAVE VALID LEAVE WHEN SHE APPLIED FOR DISCRETIONARY LEAVE. HOME OFFICE REFUSED HER CASE IN OCT 2013, SHE APPEALED THE DECISION AND JUST GOT 30 MONTHS LEAVE TO REMAIN UNDER PRIVATE LIFE. SHE DID NOT INCLUDE HER CHILDREN IN THE APPLICATION THEREFORE CHILDRENS PASSPORTS ARE STILL WITH HOME OFFICE. SHE IS INTERESTED IN APPLYING FOR UNMARRIED PARTNER VISA SHE IS FULL TIME EMPLOYED AND EARN 18000 A YEAR HER PARTNER IS CARER OF HIS FATHER. I WOULD APPRECIATE IF SOMEONE CAN HELP TO CLEAR THAT WHAT KIND OF FUNDS SHE NEEDS TO APPLY FOR UNMARRIED PARTNER CATEGORY(5 YEARS ROUTE)IF SHE IS EXEMPT TO MAINTAIN 18600 INCOM THRESHOLD. SHE IS LIVING WITH HER PARTNER IN HIS FATHER'S HOUSE. ACCOMMODATION HAS ENOUGH ROOM FOR ALL OF THEM.

DOES SHE HAVE TO PROVIDE ALL THE EVIDANCE AGAIN TO PROVE THAT THEY ARE LIVING TOGETHER OR COURT DETERMINATION LETTER WILL BE ENOUGH?
I KNOW SHE HAS TO PASS ENGLISH TEST, PLEASE ADVISE IF IT IS DIFFERENT !
WHAT ABOUT MAINTAINANCE FUNDS , IF SHER HAS TO SHOW MAINTAINANCE FUNDS HOW MUCH WILL THAT BE ?
DOES SHE HAS TO WAIT FOR CHILDREN PASSPORT TO COME BACK FROM HOME OFFICE OR SHE CAN APPLY BEFORE THAT (SINCE HOME OFFICE IS ALREADY IN THE PROCESS TO RELEASE KIDS PASSPORTS) ?

I WOULD APPRECIATE YOUR HELP AND SUPPORT IN THIS MATTER, THANKS

FLRM APPLICATION

Post by musheash » Sun Nov 02, 2014 12:34 pm

hello
i got biometric residence permit under family life category Aug this year. I am employed now and want to switch from 10 years route to 5 years route. I have just done my IELTS with 6 bands over all score. I am employed from march 2014 and earn 18000 annually. My partner is claiming carer's allowance for taking care of his father. I would appreciate if someone could help me with the salary issue. Since my appeal determination arrived in march this year that's when i started my current job because i did not have valid leave before that, but home office started my visa from Aug this year. should i include my salary slips from Aug this year after i got visa or can i show salary slips from march when i got the job after my determination came through from court. Also do i need to show six months salary slips for my same day visa application or will the last months slips be fine. Any help would be greatly appreciated.

Thanks!

You will be exempted from the financial requirement if your wife is receiving carers allowance.

The 18000 will be sufficient to prove adequate resources.

HI GUYS THANKS FOR YOUR HELP....I HAVE GOT MY RESIDENCE PERMIT TODAY !!!! THE FORUM WAS VERY HELPFUL FOR ME !!! JUST HAVE A QUICK QUESTION I DID MENTION IN MY APPLICATION THAT I HAVE 3 KIDS LIVING WITH ME FROM PREVIOUS RELATIONSHIP AND SHOWED THEIR MAINTENANCE FUNDS (£18000 P ANNUALLY)AS WELL( INCOME THRESHOLD WAS EXEMPT SINCE PARTNER IS CLAIMING CARERS ALLOWANCE), THE ONLY REASON WHY I DID NOT INCLUDE KIDS ON MY APPLICATION WAS THAT I DID NOT HAVE THEIR PASSPORTS AND BIRTH CERTIFICATE WITH ME. HOME OFFICE HAS GOT ALL THEIR DOCUMENTS ALONG WITH THE APPLICATION THAT THEIR FATHER FILED WHEN THEY WERE LIVING WITH HIM (APPLICATION IS DECLINED OR STILL IN PROCESS I DON'T KNOW THE STATUS ). SINCE THE KIDS ARE LIVING ME NOW(FROM 2012) AND I AM RESPONSIBLE FOR THEIR UPKEEP I INCLUDED THEM ON MY APPLICATION.

I NEED TO APPLY VISAS FOR MY KIDS DO I NEED TO INCLUDE ALL THE FINANCIAL DOCUMENTS AGAIN IF YES WHAT KIND OF OTHER DOCUMENTS SHOULD I INCLUDE ALONG WITH THEIR APPLICATIONS IN THE SITUATION WHERE HOME OFFICE HAS ALREADY HAVE THEIR DOCS ALONG WITH PREVIOUS APPLICATION MADE BY THEIR FATHER. I WILL APPRECIATE YOUR HELP !!! THX

Post by musheash » Mon Dec 15, 2014 1:50 pm

Hi Buddies

I need quick help with FLRFP form i am filling in. It is for my kids who are 6-5-4 years old. Kids were living with their mother(x Mrs) before but are living with me for the last two years. I am on 5 years unmarried partner route. i am looking to apply for my kids as dependents, kids do not have valid leave to remain at the moment.

I need advice basically on the form , what form should i fill in from FLRO-FLRP-FLRM-FLRFP i have consulted many people but every body seem to have different opinion. I am finally filling in FLRFP(even though i am not sure ).

I will appreciate if someone could tell me about the relevant sections of the form that i fill up before sending it through. At the moment it is very confusing dont know which section is relevant to me.

Cheers
