Lovely news for u.could u pls tell me have ur wife been tier4 or other category dependent before July 2012? I have got my ilr through long residency and my wife got her flr(m) march2014. Do u think she can apply for set(m). Pls let me know.

Hi tulib143,
My wife was tier1( general) dependent and she was granted flrm under part 8 of the immigration rules on 4 april in peo sheffield. At that time, the caseworker told us that old rules would apply to her even if she apply for setm after 6 april. I again made appointment in sheffield peo coz i thought they cod bring new changes any time. I clearly mentioned in covering letter with setm app that part287(a)(i)(d) allows her to combine the period under flrm and pbs. She didn,t have any problem. I think it will clear ur confusion.

Dear all i have been a silent reader on this forum for a while. I have just received my ilr approval based on long residence. i was tier 1 dependent up until the time i applied for ilr. My partner got his ilr in Jan but i applied in my own right as i have been here 10 years. It was a straight forward application. My timeline is:

Application sent: 24/01/14
Acknowledgement letter: 28/01/14
Bio Invitation: 05/02/14
Bio done: 0702/14
Ilr granted: 17/04/14
Documents and approval letter received: 19/04/14
Brp received: waiting

Did after 6 april 2014 ,if I want to apply for my wife on flr m visa on flr m first and than I can switch to set m . And did his period before July 9 2012 will be counted or not

Hi tanz5656,
Anybody applying for FLR(M) on or after the 06th April 2014, have to start time again to qualify for the ILR on Set(M), and the qualifying period is 5 years. Time spend previously or any time spend prior to 09th July 2012 will not be counted. I hope it helps.

But what about transitional time period. Because I was thinking they want us to convert to flr m first and under transitional period you can still apply because I say on home office Web site and transitional period is still there.

I am also waiting for decision of my application.
My time line is:-
Application submitted : 11/02/2014
Acknowledgement date:- 12/02/2014
Biometric received:- 13/03/2014
Biometric done:- 13/03/2014
Approval letter:- waiting
BRP:- waiting

Hi. Guys above my time line is given.
I was on tier 4 visa before applying my ILR.
I have two dependents( wife n daughter) as well and their leave going to expire on 30th June 2014.
Now if someone can help , I am confused on couple of things.

1- if my ILR doesn't come until 30 th June then under which application I have to apply my dependants visa.

2- if even my visa come then I have to apply my family visa under FLR(m).
How I can show minimum income threshold as I was on tier 4 visa before and I was doing only twenty hours work.
My family came to UK on 29th June 2011.

Hi Sabidh12,

Thanks for submitted your experience. I've received ILR long residence and before ILR I was on Tier1 General. I am bit confused with new rules after 6 April 14 to apply ILR for my wife. I'm also in your boat but currently my wife is on PBS Dependant. I'm thinking to apply SET(M) without FLR(M) at PEO but I'll take both forms to PEO and will tell customer service or case worker that I'm not sure which form is related to her than whichever form they ask then I'll give correct form.
If you don't mind, could you please advise for below queries.
1. When did your wife come to uk?
2. Did she get PBS dependant (I think she was on your Tier1 dependant) 2+3 or 3+2years?
3. When she got entry clearance (first time of PBS Dependant) what type of visa HO entered (ie Partner of Main applicant or PBS Dependant)?
4. Why didn't you try straightaway to SET(M) for your wife when you had an PEO before 6th April rather than to apply FLR(M). because of some people got ILR without FLR(M).

Its been quite few days, hopefully after Easter holidays, Tuesday/Wednesday we get a lot of good news.

I've been looking at that document on one drive for a week now, and these Easter 4 days had been longest 4 days I ever remember.

yes ketu you can apply for her SET M after FLR M application has been approved. She (your wife ) will need to show prove of maintenance as stated on the guardian of both forms above.

Hi Suryavaddi,
If you havnt applied for FLR (M) before 6th April you cannot take transitional route. The changes made on 6th April means you will apply for FLR(m) and after spending 5 years on Flr (m) you can apply for SET (m). I am very sceptical about this rule and I hope there will be some JR and it will be changed as its unfair.....

Hello suryavaddi,

You can't apply setm straightway. You must have to apply flrm 1st and then setm(after 5 years from 6april onwards). Now i will try to ans all ur ques.

1. My wife has spent more than 7 years in uk.
2&3. She got tier1(general) partner visa.
4. I booked appointment in peo for setm but took flrm with me. The caseworker told me clearly to apply flrm first and then after 24 hrs i could apply setm. She told me that they had given setm straightway but it was a mistake. So my wifegot flrm (b4 6 april). Then after 6 april, got setm under 287(a)(i)(d).

Hi Guys,

I hope you can help me. I just got my ILR (LR) on 15th of april.

Now i was on Teir 1 before this. My wife's Dependent visa of Teir 1 expires next year april 2015.

Now my question is how long do i have before i apply for her FLR (M). Do i have to do it straight away or is there any timeline?

Please Help on this...... i understand now she cant apply for SET (M) because of the rule change of 6th April 2014.
