April 2018 ILR closure is for Tier 1 General Application.
Any one on Tier 1 General won't b able to apply for ILR on the basis of 5 years after April 2018.
Hope that Helps.
Regards

quote="Spatacus"]Hello rwhizza can u tell us where u get the information about ILR closing in April 2018????

rwhizza wrote:I have been silently reading this forum for the last 6 months. My Ilr is due in a few weeks time but I have confusion on few recent changes.
My 10 years include 5 years tier4, 2 years psw, 3 years Tier2.
My wife joined my in April 2010 as my psw dependent. Now she is dependent on Tier 2.
As per recent changes on 6th April I understand that she has to apply for FLRm and she is not eligible for SETm for another 5 years.
but Ilr route is going to be closed after 2018 which makes it more frustrating. :x
Her current visa expires in october 2014, by then I hope I will have my ILR.
When do I apply for her FLRm? Is it at the same time as my SET(lr) or after I recieve my decision.
Or do I extend my tier 2 for another two years and apply through 5 years rule so that my wife qualifies as well.
this new rule doesn't make any sense at all considering the timing of ILR route closure after April 2018 will leave us in further 4 years wait to make it 14 years lawfull residence till she qualifies.
I will appreciate if someone offers some advice here.

Hi,
It is crystal clear in Sabida12's case that he/she got FLR(m) before 6th April and old rules apply. In your case you are applying after April 6 and you cant extend your leave under Part 8 as I shared in pervious post. So 287 (a)(i )(d) is only implemented when Flr (m) is granted under pervious rules in case of PBS dependent. All PBS dependents have to Apply through Appendix FM.

If you guys read through this forum for last month or so these question are answered many times....

Spatacus wrote:Thanks KashRIz. I completely understand where u are coming from, I will appreciate it if you can read part 8 of 287 (a)(i )(d), according to sabidh12 he has used this rule and it worked for him.

KashRIz wrote:Hi Tanz, Surya and Spactus,

Hope you guys are well. HO made a change on 6th april in Part 8 which is about transition.HO office has changed the law and excluded PBS dependents to take that transitional route if they get ILR by long residency NOW IT DOSENT MATTER WHEN U ENTERED OR SWITCHED AS PBS DEPENDENT AS YOU CANT EXTEND YOUR STAY UNDER PART 8. We can check THIS CHANGE in Part 8 284 (c) as under.

284. The requirements for an extension of stay as the spouse or civil partner of a person
present and settled in the United Kingdom are that:

(i) the applicant has or was last granted limited leave to enter or remain in the United
Kingdom which meets the following requirements:

(a) The leave was given in accordance with any of the provisions of these Rules;
and

(b) The leave was granted for a period of 6 months or more, unless it was granted
as a fiancé(e) or proposed civil partner; and

(c) The leave was not as the spouse, civil partner, unmarried or same-sex partner
of a Relevant Points-Based System Migrant; and

https://www.gov.uk/government/uploads/s ... MASTER.pdf

So lets be very clear about it that any one applying FLR(m) after 6th april have to fill 7a for finances and then wait for 5 years to apply for settlement. If you guys read through last one months discussion on this forum it will be very helpful to clarify this ambiguity. I my self applied for my partner's FLR (m) on 5th april just to avoid these new rules. The application forms are almost same as before April 6 as Law is changed.

My Timeline was present in SKYDRIVE till two weeks ago. I have just checked it is missing for some reason. I'll update it once I go home as do not have access to modify the Office docs here in the office.

Hello,

Can we challenge this 5yrs waiting time rule in court. If yes, what are the chances to win the case.

Thanks
