can anyone advice please?
Hi T.Ahmad,
Regards to your wife, you are right she need to apply for FLR(M) before 15th August. With that application you need to send them a covering letter explaining that the Home Office should put her application on hold until they reach final decision on your application, because she is your dependent and you are her sponsor. I hope it help. All the best with your and your Mrs applications.
Kind regards
Shahjee
ASA Shahjee,
I have a question to ask ; when you applied for your wife FLR M did you attach original nikah nama / marriage certificate or its certified copy? Or you did not attached any thing?

Or if any one have applied FLR M / FLR FP you guys attached marriage certificate too. I am applying FLR FP for my wife next month along with mine SET LR. Many thanks

Hello
Yes 18600 is fine , but I don't think you need to send whole bunch of documents , I think your applying for spouse visa and when ur wife go for settlement than you need to show that your living together from last two years , it's fine you send documents but it's not compulsory. As I called home office and spoke to very experienced lady and she explained me all that. For your salary you alone or combine need to show 18600 salary slips bank statement per is fine .

2)all my kids born in uk can i apply for British registration or i have to wait until my mrs get ilr??
3) my mrs is living in uk as my dependent since 2006 continuously.she was my dependent on tier 4 for 2 years psw 2 years and Tier1 3 years so does it mean she has completed the require period for ilr which is 2 or 5 years can she apply straight away for ilr now?

Hi redrosekhan,
The answers to your questions are
1) yes that is the exact letter that I received, so no worries, it is all done. Once you receive your BRP that will say Indefinite leave to remain.
2). No you don't need to wait for your Mrs ILR, your ILR is good enough for that. As far as one of the parent have ILR the British born kids can apply for British passport.
3). No she can't apply ILR straight away, as she have to first apply for FLR(M), which is further leave to remain as dependent of a settled person. The rules have changed since 06th April 2014, any one getting FLR(M) after that date have to spend 5 years qualifying time for ILR, any time that they have spend in the country already is null and void, so in your Mrs case, she has to begin her time again after she get her FLR(M).
I hope it helps mate. All the best.

Hi Malavan,
Yes pay slips, P60 any things that prove that you are earning £18,600, the income can be collective house hold, means you and your Mrs together.
She will be issued with a 2.5 years visa extendable for another 2.5, for a collective 5 years, and after that 5 year she will qualify for her ILR, I am afraid she can't apply for ILR straight away, she need to spend a new qualifying time of 5 years, any time that she has already spend in the country is null and void and is not counted to her qualifying time for ILR. I hope it helps. Many thanks.

This forum has been helpful. I still continue seeking help from it. I was going through some of the posts where people said that spouse has to complete 5 years route in order to get ILR from now on.
To my understanding, We could apply for ILR right after getting FLR(m) if spouse came to The UK before July 2012. It was also mentioned in Home Office's guidelines on its website.
Amber also created a thread in regards to this rule being changed. Can someone please shed some light on it? When did this rule come into effect?
Thanks in advance.

Yes, that is correct, ILR (LR) dependants have to wait now for 5 years after they get their FLR(M). This is regardless whether the dependant came before July 2012 or not. They can't combine their previous leave. The clock resets to zero as soon as the dependant get their FLR(M) visa which would be initially for 2.5 years and would need another extension for 2.5 years after which they can apply for their ILR. This rule came into effect from 6th April 2014.
