brother your wife is eligible for settlement .however there is some error by home office and they refuse all tier 4 dependant cases. i hope you are aware of it. I am in the same boat as yours . i recently sent a complaint to home office saying that incorrect information is provided to me by UKVI cusomter services. i have got UKVI letter saying THAT I CAN COMBINE MY LEAVE AS TIER 4 DEPENDANT AND APPLY FOR ilr A I APPLIED MY FLRM BEFORE 6TH APRIL . I have got my peo appointment on 1st nov .iwill take that letter with me . i can forward you that letter if you send me your email my situation is exactly like yours. my suggestions to you write a similar complaint like me so that you have written proof of eligibility otherwise the case worker will not treat yuor case (there are examples like this in past from this forum)

Thx Shahjee for the reply. My husband applied in April so he got his ILR in Sept 2014. When we travelled to Pakistan one year earlier in 2013 , my child was not entitled to British citizensip but now since the visa is changed and he is settled , my ist question is can we apply for our kid's citizensip overseas? irrespective of her immigration status. Secondly, as you said could be problems if I travel as Tier 1 dependant should I switch to new stauts but its going to take long as we are expecting a second baby and his birth should be in uk. We are in a muddle. Need your suggestion plz.

Hello meghankit,
i don't think there is anything you can do at the moment if you fall short of £250 from meeting the £18,600
All you can do is to use application form FLR(FP). Most senior members of this forum can advise you more on this. :roll:

Your time starts counting from the day you arrived in the UK, this topic has been discussed in this forum before.

"Applications received more than 28 days before the required qualifying period is completed. You must refuse applications received more than 28 days before the applicant completes the required qualifying period for long residence. This is because the applicant has not completed the required period of leave in the UK. You must fully consider the case and mention any other reasons for refusal in addition to the applicant not spending enough time in the UK to complete the qualifying period. For
example, all breaks in continuous residence. Applicants who are refused under the long residence rules due to them submitting their
application too early can re-apply once they have completed their qualifying leave or up to 28 days before this."

Spatacus is absolutely right. Or the second option for you is to show required saving in your bank account for the past six month to apply on flr(m). The amount you need to show will be £16650. Hope this make sense to you

Pls can someone advise me pls. I have read the guidance that I can vary my application, is this true and uncomplicated?
I am struggling to complete the fees for LR. I applied for FLR O, got declined and appealed, had d hearing but awaiting the decision. I am now 10 yrs. Can I vary the initial appeal n pay the difference in cost? And how do I vary the application?

Can you confirm the dates with your friend that
what date his Mrs applied for her FLR(M)?
I am dead sure that she applied it beofre the 6th of April 2014,
and than could you also confirm with them that,
Did she received a 2 years visa on that FLR(M) ?
Yet again I am dead sure on that, that she received a 2 years visa.
If both of the above statements are correct than she was still covered under the transitional arrangements, any application after the 6th of April 2014, from a dependent of a settled person through long residency i.e 10 years long stay, have to apply FLR(M) through Appendix(FM) and I don't think that paragraph 287(a) is relevant any more.
If you can kindly confirm these dates for us, that will be great, as there are many members who can take advantage from your friends case, and this information is very relevant, especially to the dependents of settled person through 10 years long residency.

Now I have seen the updated rules (28th July 2014) and found that in immigration rules part 8, still 287a 1 d is existing and states that
"__(d) the applicant was admitted to the UK or given an extension of stay as the spouse or civil partner of a Relevant Points Based System Migrant; and then obtained an extension of stay under paragraphs 281 to 286 of these Rules and has completed a period of 2 years as the spouse or civil partner of the person who is now present and settled here."
