Hi Guys,
I am about to apply for 10 years long residence permit but will need your advise to know if I am eligible. I came into the country in July 2004 with a student Visa. I applied to renew my Student Visa in July 2010, but was refused in which I appealed and was given a date of hearing for Mid November, 2010 and also got a letter stating I will maintain my student visa status till the hearing date. I left the country in October, 2010 due to an urgent issue back home and informed my Solicitor to withdraw the appeal few days after I left the country. I came back to the UK early March 2011 with a Working Visa - PSW (Valid from 2 Feb, 2011). Now I am concerned about the gaps, the periods I left the country and the periods without a Visa back home.

Please advise.

Hello Mate,

Long residence rule is stay in UK for 10 years lawfully that includes you should not have spent more than 180 days out of UK at once and 18 months all together in 10 years, it seems you have spent more than 180 days out of UK if you have any strong reason you can explain to Home office with evidence they may use discretion on your case there are few cases I have seen where they have issued ILR with gaps..

you are fine there is no gap. all u have to prove that when u left the country u have valid leave which u did because ur appeal was pending which covered u under 3c 3d and then u came back to the country within 6 months with a valid leave.
i would suggest that u send ur application through a solicitor who can explain ur situation and give some references. it might cost u but think of it as this way that this the last time u will have to pay for the visas and u should get it by a good one regardless of cost

This is to let you know that by the grace of Almighty Allah my set (LR) application has been approved. I want to share my experience with the forum as my case wasn't straight forward.
- Applied Tier 1 Entrepreneur in March, 2013
- Visa refused with the right of appeal
- Appeal lodged in FTT
- Appeal Adjouned once in july, 2014
- Pending Appeal with FTT for last fourteen months
- Withdrawn Appeal from FTT
- Received withdrawal letter from tribunal after 24 days and then applied for ILR
- Passport expired during this lengthy process
- Expired passports received along with other documents
TIMELINE
Applied : 06/11/2014
Acknowledged: 10/11/2014
Bio received: 18/11/2014
Bio recorded: 22/11/2014
Approval: 26/02/2015
Doc Received:03/03/2015
BRP : Awaiting

Thanks, but does the 10 years 180days rule apply for long residence like it does for 5years..e.g

I intend to apply in 28th January 2016: which means the 180 days will apply as:

28th Jan 2015 - 27th Jan 2014
28th Jan 2014 - 27th Jan 2013
28th Jan 2013 - 27th Jan 2012
28th Jan 2012 - 27th Jan 2011 - 52 days
28th Jan 2011 - 27th Jan 2010 - 91 days

after receiving approval how long it takes BRP to arrive please

also if anyone can guide me on the following please

i am waiting for my wife's FLR(M) now,
do i need to send them any of my documents?
how long it takes for her docs to arrive?

Question: I have spent 3 years under UK immigration (as a student from 2004-2007)and 7 years under eu (family member of EEA from 2007-2014). Can I apply for indefinite under 10 year rule even though I spent 7 years under eu status ?

Please help.

Hello mate, yes you can apply on 10 years basis.

Its been 5 months and 5 days since i applied for ILR and more than 3 Months since i enrolled for bio-metric, no result yet. Called HO today, same old respond..please continue to wait (forever...until u get pissed and pulled your docs out). wondering would that be a good idea to send a letter through my solicitor asking for the status/update/cause of delay of my application to caseworker in writing. Does varying application takes longer than other application?

Time line is : alam_m(Daughter)
App made: 15/12/2014; Acknowledgement: 19/12/2014; Biometric received: 23/12/2014; Bio done: 30/12/2014
Biometric card with approval received: 03 March 2014.

COULD SOME ONE PLS UPDATE IT IN THE TIME LINE (Google Doc)

Note: sorry, as I previously quoted the approval date as 03 February 2015; actual date is 03/04/14

It's exactly five months for me too and I also varied my application, perhaps they take long on some application, was your case was straight forward ??

Just now I have received my daughter's ILR (Set LR) biometric card but haven't received anything before. Hopefully approval letter (!!!) and supporting documents will follow soon.

I am told by different solicitors that I can't apply for ILR on a 10 year route as 10 year option doesn't apply to EU cases.
Can you please elaborate more ?

Hello Raf,

I don't know why solicitors said to you why you can not apply. If you read guidence of 10 years long residence it clearly says "you have lived in UK for 10 years lawfully" it doesn't says what kind of visa category you had or you have in 10 years as far as you spent 10 years lawfully you are eligible for ILR.

Two years pending application it's long what application was that ? I applied flr fp in July and and varied in October and received refund fee for 1st app on 14th November and bio on 2nd December ...
Have you received refund for 1st app ???

Hi mate of course you can either apply for set (lr)or you can apply for PR having spent 5 years as EEA family member

Yes yask I agree you ,if you spent 10 years lawfully that's it you can apply .
