I don't think that the premium service is the right one for you. After all, they will have to decide it more time and it will take months for you to decide the application. Your case is a complex case and they won't be able to just decide it right away.

omi123,
Quite a complex one you have here at first glance. But a closer look on the first case shows a bit of straightforwardness. Beyond the need for a crack team of lawyers (which I assure you does not help many a times) is the paramount need that you present a story that is sure to tog on the human nature. So, think about your story. What is it? Have you got UK-born children? What is ur level of attachment to the UK vs your home country? ETC. These are rhetoric questions. One might argue that if you are within your rights, it will be granted. In an ideal world, yes. But the last thing you need now is another first-glance refusal, based on the caseworker's laziness to follow your timeline through, technically. The only way to prevent that and force due diligence is by including and answering the questions raised, where appropriate. Please, highlight issues that pertain to the human rights legislation, if opportuned. Good luck.
Opinion is researchedly mine!

hi, I applied ILr on 10 years route through postal on 3rd of november. done my bio on 09-12-2016. than on 13-12-2016 apply for upgrade but they reply me than i m not eligibleto upgrade. anybody knows why m i not eligible to upgrade? also does anybody hv any rough idea how long does it takes to make a ilr decision on postal service? my case story is below.

came 10-01-2007 in uk.
first ext 31-03-2010 till 25-05-2011
got psw 22-07-2011 till 21-07-2013
tier 4 22-07-2013-19-08-2014
tier 4 06-10-2014 till 07-01-2016
apply flr fp 07-01-2016
varried flr fp 22-04-2016
varried set o 20-07-2016
varried set lr 03-11-2016 although i am eligible for set lr on 13-12-2016 as 28 days before but i did the variation a bit earlt than the due date.

so anybody have any idea why i wouldn't be eligible my application to upgrade on my due date also how long roughly does it takes to make a decision on postal ten years ilr application to get a decision?

a) Perhaps due to your 'frivolous and vexations' 'time buying' applications you have submitted since January

b) You applied for ILR too early. You will just have to wait for the outcome. Not sure why you applied for ILR on Set(O) though when you did not hold a qualifying visa to apply in that category.

Just wondering why you applied ILR in 2016 when your 10 years is not complete yet? It could be perhaps possible if you applied in Private Life application and vary your application when you complete your 10 years.

It seems that your case is complex.

Your continuous stay is broken under LR unless your status is being reinstated to leave to remain.

If I may ask you. Do you have family here or children? Without any proper history of your application, it's hard to understand and comment.

Thanks

Am i eligible to apply for a 10 year long residence applicat

Post by hamrohari » Sat Jan 07, 2017 12:12 pm

Following is my immigration history.
28 Jan 2007: Came to UK under General Student Visa
11 March 2010: Extend my visa under Tier 4 student (1 year)
3 Aug 2010: Switched my visa to Tier1 Post study work (2 years)
31 July 2012: I made Tier 2(Skilled Worker) visa application without COS stating - my employer is awaiting response from Home Office for their license. (My employer’s license was rejected 2 times during the process)
25 January 2013: My application for Skilled worker Tier2 was rejected
29 January 2013: Appealed to First-Tier Tribunal
17 April 2013: First Tribunal refused my appeal
23 April 2013: Appeal to upper tribunal
25 June 2013: Hearing from upper Tribunal, Grant to apply a fresh application
Within 28 days of the hearing I applied a fresh application
August 2013: Got skilled worker Visa
August 2016: Extended Skilled worker Visa (Expires on 25 Jan 2019)
28 Jan 2017: Is going to be my 10 years in UK
Question:
Will there be any issues for my Long Residence application?
Shall I go for same day application?
My employer’s sponsorship license is expiring on March 2017. Will that be wise enough for my employer not/to renew the license?
I got married on December 2014 and my Mrs is in dependent visa on me. Will she be eligible to apply for a Long Residence too?
Please advise. I would really appreciate your help. Thank you.

what was your previous status? I am looking to vary my application from set o to set lr. do you suggest varying PEO same day is better? thanks

Hi All

Applied for the wife's ILR visa on Long residence second week of september. Biometric done on last week of september. Still haven't gone anything back. I am aware that it is still within 6 months but was wondering if anybody else has heard anything who applied around the same time.
Any feedback would be appreciated.
Thanks

Hi,

I have been in the UK for 10 years and would like to apply for ILR under SET(LR). My question is that I originally entered the UK as a US study abroad student on Jan 2nd 2007 using the 6month visitor route. In June of 2007 I was granted a student visa to continue my studies in the UK. I have been in the UK on various student visas (no gaps) until October 2012 when I switched to a Tier 2 work visa and have been on this visa since then (again no gaps).

My question is will the time I spent here as a visitor in 2007 count towards my 10 years, in which case I am eligible for ILR now, or does it not count until I received my student visa in which case I have another several months before I am eligible. This matters because my Tier 2 visa is up for renewal this month and if I don't want to pay for a new Tier 2 visa if I can apply for ILR instead.

Thank you for your help!

Hey All ,

i went for my 10 years Long Residence premium service and they retained my profile by saying that your application is Valid but we need more assistance. I specifically ask the case worker about exact reason and she said we need your old passports which are already holding by Home office in my last application of Tier 1 Entrepreneur and it was refused but i went for appeal.

Anyone knows how long they normally take to respond in that kind of case ?
Do you think my application has been approved but just becz of missing passports they hold it ??
I never been out of UK more then 80 days in my 10 years history

It must be very confusing to get refused for that reasons. I was thinking that Long residence is based on 10 years. Will they actually check everything? Also, If you did not mention for the contract, Why didn't they ask when you had interview?

I believe Omi Boy is referring to his Tier 1 Ent extension refusal not ILR LR.

Hello everyone,

I applied for my SET(LR) application yesterday through premium service at SHeffield visas and immigration centre. I have successfully received my ILR approval letter and will be receiving my biometric card shortly through my solicitor.

To give an overview, I had applied for a 10 years long residency visa which includes student visa, PSW visa, Tier 2 General visa and a Tier 1 Entrepreneur visa. During this time I was caught out driving without an insurance which was quite stupid obv and was convicted guilty by court with a penalty of 4 points and 6 months ban. I paid a fine of 350 pounds after submitting my mitigating circumstances letter and explained my situation well to the magistrates. My license was revoked and I have however passed my practical and theory again.

The reason why i am commenting is that prior to my application I was discouraged a lot by other people when I had mentioned my conviction in front of them and that I would definitely need a solicitor's advise if I wanted to stand a chance which I did. I explained my case to the solictor where I had explained that besides this driving conviction there is nothing shoddy of my immigration history. I was advised to keep my application straight as this was a 10 yrs residency route and if I had accomplished the basic requirements like, not exceeded 540 days outside uk, not exceeded 180 days in a single visit, no serious crimes, lifein the uk test.

The documents that i had submitted were
1. application form with 2 passport pics
2. all the passports covering my 10 years of residency
3. all visas covering 10 years residency
4. Uk Bachelors degree
5. Ielts test certificate (not required though!!)
6. Life in the UK test certificate
7. driving conviction letter

Thats about it.
I gave in my application at 1045am, biometrics done by 1120am, approved by 1230pm. During this whole time I was just asked one question and that was 'When did you take your photographs?' THATS IT!!.. I would encourage everyone to make their ILR long residency application once they have completed their 10 years lawfully and not to load their application with unnecessary documents giving the home office officials to suggest otherwise. By all means go to a solicitor but look out for ones who are trying to extort money from us.
