Hi

I would like to thank the contributors of this forum for the wealth of information available here. It is so really helpful.

I have some questions on my eligibility for ILR, degree and bank statement requirements.

Completing 5 years on: 10th May 2015
When do I plan to apply: 8th May 2015 (though I can apply 28 days before I am not due to other unrelated reasons)
Current visa status: Tier 2 ICT
Qualifying 5 years are as follows:

Year 5 - 11th May 2014 - 10th May 2015 : Tier 2 ICT (extension in UK and visa valid till Jan 2016)
Year 4 - 11th May 2013 - 10th May 2014 : Tier 2 ICT extension in UK
Year 3 - 11th May 2012 - 10th May 2013 : Tier 2 ICT extension in UK
Year 2 - 11th May 2011 - 10th May 2012 : Tier 2 ICT extension in UK
Year 1b - 16th July 2010 - 10th May 2011 : Switched to Tier 2 ICT in UK as WP expired
Year 1a - 11th May 2010 - 15th July 2010 : WP (Intra Company Transfer - Multiple Entry). WP was originally issued in July 2008 for entry clearance. I visited the UK on it in Aug 2008 for a month, then 5 months between Nov 2008 - March 2009. Once I returned in March 2009 I did not renter until May 2010 as mentioned in Year 1a above.

Questions:
1. Does the qualifying 5 years make me eligible for ILR?
2. My degree college was re-named (upgraded from a regional institute to national institute and made a university on its own) a few months following my graduation in 2002. The PBS calculator shows the new college name and for that gives me 30 points for degree and 10 points for English language. But as the college names do not match between the PBS and my degree certificate is that a problem? The name of university in my degree certificate (to which my college was affiliated before it was renamed and made a university on its own) is also present in PBS and does give me 30 & 10 points. Not sure what do?
3.Usually for Tier ICT to ILR you only need to show last 3 months bank statements so I am fine but if I am asked to show statements from previous years (for example, as additional proof for paid annual leaves) then the problem I have is that there was a single letter spelling mistake in my first name in those. I have corrected it with the bank recently hence the latest 3 months will be fine but unfortunately the older ones will not be!

Regarding your degree certificate issue, I think if you can get a letter from the university stating that your college was renamed from xxx to yyy on ** data, then you will be fine with a PBS printout and degree certificate.
However, given the uncertainities (since I have not seen any cases discussed in this forum before akin to yours) and difficulties in getting a university letter, it is safe and easy to obtain a english B1 certificate. You may need to spend circa £125, but atleast you will get peace of mind. As your appliation is only due on May 2015, you have enough time to find a test slot, clear the test and obtain the certificate.


For the bank statement name issue, i think you will be fine (your account number, address details are going to be same in the old/new statements).
Moreover, you will submit a letter from employer to substatiate your paid holidays. In that case, the last year bank statements are redundant. What about your last year payslips? You can also use them if the case worker needs additional documentation.
