90 Days clerification to ILR

Post by ijaz123 » Wed Jan 08, 2014 12:52 am

Can someone from their knowledge or experience help my situation Please....

MY details:

1. Tier 1 General stamped on the 3rd Feb 2009 for 3 years
2. Entered UK on the 5th of April 2009 (62 days later than EC Stamp Date)
3. Got Extension for 2 years 3 months - Expiring on 5 may 2014

I did not stayed outside UK for more than 90 days in any year.

When is the earliest i can apply for my ILR.. Is it 28 days before 3rd February 2014 (5 years to Entry Clearance Visa stamping date) or 28 days before 5th April 2014 (5 years to First entry to UK) ?

please help:
Hi, first of all thank you all is a really useful forum.
I will apply for ILR first week of Feb 2014 using a SET(O) from a Tier 1 general.

I've completed my 5 years in the UK, I've never been more than 180 consecutive days abroad. but:

- I was 92 days abroad in the following conditions: I was in mid terms from London School of Marketing finished in Dec 2010 and my next term started Feb 2011. I finished working for a company in Nov 2010 so my wife and I went to visit our families and sort out few things in our country in that mid term. We registered before we left in the police that we intended to came back by Feb 2011. After I started to work as self employee and keep on with my studies.

What docs you suggest I should bring to justify my absence?

Does my wife have to probe her absence as well?

Thanks for your help.

Hi Lamiaclave.

I am on the same situation as yours. My dates are as below. I am also confused when is the right time to apply. I think I would be eligible to apply 28 days before 26/04/2014 and thinking of applying on March end. This is also because, UKBA might raise visa fee again after April which they normally do. Are you applying by post or at PEO? Could you please update me about your progress once you make your application?

First visa stamped for three years on - 26/04/2009
Arrived in UK - 10/07/2009 after 75 days of visa stapmed
Extension of two years till 24/05/2014

When do I qualify for ILR application? 5 years from my first visa stamped date (26/04/2014) or current visa expiry date (24/05/2014)

I would like to hear from anybody who had similar case and successfully applied.

Many thanks.
