Hi, please help me whether I am eligible to apply for ILR.

I came to UK in Nov 2008 on my work permit visa and left UK in Sep 2010 for my wife delivery (My work permit expired in Nov 2010).

I came back to UK again in Feb 2011 on Tier 2-ICT visa and I am still in UK.

I don’t have any leaves more than 180 days so far… Am I eligible to apply for ILR ??

Please advise.

Do you satisfy 245AAA and 245GF?

Hi Vinny,

Apologies for long pause... I checked your link.. Still not very clear on my eligibility..

My work permit visa ended Nov 2010 and initiated new visa by January 2015 and entered UK in Feb 2015...

Is this considered as break ??

Please advise experts...

You may have broken your continuous residence, if you didn't apply for entry clearance within 28 days of your leave expiring, as per 245AAA(a)(ii).

If your continuous residence is broken, as suggested by Vinny, be aware that Tier 2 ICT visas issued after April 2010 are not eligible for applying for ILR.

So, even if you complete 5 years on your ICT visa, it would not count for ILR.
