Can I apply for ILR now - DLR?

Hi All,

I'm writing regarding the above question, 'can i apply for ILR?'

I've been granted discretionary leave to remain twice for the past 6 six years, 3 years at a time. I've been married to a British citizen for 5 years and we've a child together. My annual salary is GBP39000. I've studied an HNC course here in the UK, taught and reasearched in English. I've done reasearch and stuff but still unsure if I'm following the right path, as we all know filling in the wrong forms, wrong fee payments just makes the whole situation even more stressful. If you can, please can you help with some advice on the following questions;

1. Am' I now elligiable to apply for ILR?
2. If so whch form do I need? (SET(M))!!, if not which one?
3. Do I need to sit the Life in the Uk English test? I suspect I do!

These are the questions I have for now, I hope you guys are able to shed some light.

1. What date was your first DLR granted and when does your current DLR expire?

My first DLR was granted on the 31/10/2009 and my current expires on the 17/07/2016.

Yes, seems you are ok to apply now as you have more than 6 years on DLR.

Thanks for your reply. I'very had a look at the SET (O) application forms. There don't seem to be a category best suited for me. As I'm applying as a married spouse of a British citizen. Is this correct?

On Set(O), you apply under the category below if you have DLR.
Other purposes/reasons not covered by other application forms

Hi Guys,

Question,

I'm curently awaitng response on my ILR (Applied on the 15/07/2016, Biometrics done), I need my passport for security reasons at work.

If I ask HO for my passport to be returned, will work against me for my ILR application?
