child under 18 ILR SET(F)

Post by ak47 » Wed Nov 25, 2015 4:48 pm

Hi all,
How long a child must be in UK to apply for ILR under set(f)? For spouse its 2 or 5 year route. is there any such requirement for minors? The baby was born outside UK when both parents were on ILR and is now in UK on settled person dependant visa. I'm a BC by naturalisation and my wife is on ILR. Thanks.

If both parents were on ILR when child applied for entry clearance, then child should have been granted ILE.

Hi Vinny,

We applied from outside UK through visa4uk.fco.gov.uk website and selected Settlement - Child or other dependant of Settled Person visa. In the passport the visa had 30 days entry clearance stamp i.e. the child must enter UK within 30 days. Once arrived to UK and collected the biometric card, it says DEPENDANT - LEAVE TO ENTER but the card also has issue date Aug-2015 and a valid until date May-2018. So I'm confused if this is ILE or not and if the expiry date corresponds to biometric card expiry? Thanks.

Hi Vinny, I called UK Visas and Immigration contact centre Telephone: 0300 123 2241 and they confirmed what was issued is ILE and once you touch UK soil its ILR. No further extension is necessary. The expiry date is for entry only. Hope this info helps others as well. Thanks.

Does the observation field have "ILE"
Or "Indefinite Leave to Enter"
Etc?

No. Only the biometric card says DEPENDANT - LEAVE TO ENTER.

The ILE endorsement should be explicit.

I think you should get it corrected.

Will this be a correction on biometric card or Entry clearance stamp?

Perhaps both. As they have issued the biometric card, then the biometric card should be corrected too. It should show Indefinite leave.

Hi Vinny,
The entry clearance stamp says Type : To Acc Mother/CYR. Referring to the endorsement codes pdf, its 301 which falls under section "One parent present and settled and the other being admitted with a view to settlement". So what is issued is definitely wrong since we both were on ILR. Thanks. They should have issued ILE with expiry date same as passport expiry date. Thanks.

You are correct. 301 is not applicable.
