Date of Entry in UK - 90 Day Concession & 28 Day qualifying

Post by rajivmathew » Mon Mar 16, 2015 1:05 pm

Hi Seniors/Moderators,

My case is as follows

Tier 1 - Valid from 15/3/2010
Entered uk on 11/6/2010 i.e 89 days from Visa validity date.
Current leave expires on 26/4/2015

What date could i apply for my ILR considering the 28 day rule?
Should it be no earlier than 28 days from 15th March 2015 or 28 Days from 11th June 2015 ?

Also Can you please confirm the following questions

a) What date to fill in the SET(o) form for the date of arrival in UK? Considering the 90 day concessionary period.
Will this be the visa validity date (15/3/2010) or the date of entry into UK (11/6/2010) ?

b) How long have you been in the UK?
Should I consider the visa valid from date i.e 15/3/2010 to be the earliest date for counting years in the UK? or will this be the actual entry date in the UK i.e 11th June 2015?

Can you please respond immediately as I am waiting for this clarification to ensure I make the correct decision.

Thanks,
Rajiv

You can mention exactly how long you are in uk. You can go for ILR on or after Sunday, 15 February 2015

Hi Seniors/Moderators/Suresh,

I have doubts on the following points

a) Section 6.1 asks, when did you ( the main applicant) first enter the UK? This refers to the date of your first entry into UK at the beginning of the period of stay on which this application is based.
--- I entered 89 days after date of visa grant (which is below 90 days concessionary limit) , does this mean that this would be the date of visa grant and not date of exact visa entry stamp in UK?
Eg: Visa granted 15 March 2010,
First Arrived 11 June 2010
Does this mean that I can write 15th MArch 2010 as the first entry date considering the 90 day concession rule?
Please clarify.

Thanks,
Rajiv

I think you have been answered to the point .

I am in the same situation, using 90 days concession period and applying before 28 days of the 5th anniversary of the date of stamping of first visa. I strongly believe that this should be fine.

As far as answers on the form are concerned, I plan to use :
date of entry -- -Actual date of entry and not date of stamp of first visa

how long have you lived - actual length which will be 4 years 10 months and days .
I will explain in additional comments and cover letter and that i am applying under the 90 days concession period as per published guidance.

Hope this helps.

Thanks for the advise.
I have query:
I have a package of 40 K but have taken a weeks paternity pay(during which salary is less than the normal daily rate) due to which the annual pay has come down to 38,780.
While claiming points for salary i am a bit confused if i need to mention the package amount 40,000 or the amount I received in the last 12 months. Can any seniors/moderators please advise.
