ILR Application date

Hi all,

I am worried about ILR application. Below are the details

First tier 1 general visa date - 23 July 2010
Entry in UK 23 Nov 2010
First extension 24 Oct 2012 till 25 Oct 2015

By 25oct 2015, I ll complete 4 years 11 months 3 days.

Now my question is can I apply on 23 Oct 2015, will it be considered as 5 years for ILR application.

Since your entry date vs actual date of initial grant of Tier1 visa is more than 90 days so

ILR Qualifying Start Date = 23 Nov 2010
Earliest ILR Application Date = (23 Nov 2010 + 5years) - 28 days
=23 Nov 2015 - 28 Days
= Monday, 26 October 2015

So Apply after Monday, 26 October 2015

Please check the information you are giving, OP has clearly stated that the visa expires on 25th October.

Quotes from SET(O) Guidance Notes Version 04/2015

5. When to apply
You and any dependants applying with you should apply before the end of your/their permitted stay
in the UK.
There is a qualifying period to complete in most of the categories on this form. It runs either from
• the date on which you entered the UK with a visa in the relevant category; or, if you did not
enter the UK with such a visa, from
• the date on which you were first granted permission to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or more after the date from which it was valid for use,
you may need to apply for an extension of stay to complete the relevant qualifying period.
[b]Please do not apply more than 28 days before completing the qualifying period. If you apply earlier
than that, your application may be refused. If that happens, we will not refund the fee and you will
have to pay again when reapplying.[/b]

Thanks for the information. I'm still bit confused on how to count backwards the 28 day period.

Suppose I complete my qualifying period on 26th June 2015. So should I count backwards taking into account 26th June as the first day or 25th June as the first day. If I take 26th into account then I can apply on 30th May and from 25th June it gives me 29th May.

Also 26th June - 28 = 29th May

Please can members share their experience.

Hi Everyone,

Thanks for all your kind suggestions and information. Now this is very bad situation for me as I am just 1 day away from 28 days before applying for ILR application. The problem is now they have closed Tier 1 general extension as well.

Now what should I do, I am clueless and worrying now.

Why do you not do what CR001 has suggested? IMHO you should be fine then, as you will be covered by S3C until the application is decided, and also meet the residence requirements.

From when they calculate 5 year period, from post date or application start processing date ?

If you post it as I have suggested, you will meet the requirement by the time they start working on your application. It has to be posted before your visa expires.
