ILR application - Set(O) - Child benefit question?

Hi,

Currently I am holding a Tier 1 General. Going to reach my 5 years fairly soon.
End of March, I'm going to apply for my ILR application (Set(O)).

However, I got a question as everyone knows that any point based system based visa does not allow the holder to apply any public funds (eg. Child Benefit).

My wife has got her ILR since Oct 14 and we just had our first baby (born in the UK) in Dec 2014.

She just applied child benefit for him and we got the approval 2 weeks ago.
She is the main applicant but they need the spouse / partner details also in the application.

Would that affect my ILR application in March as the rule is when applying ILR, you cannot apply for any public funds?

You didnot apply for public funds. Your wife did.
She is entitled to apply for it since she got ILR.
There is absolutely no worry for you, as long as you did not apply for any benefits.

Thanks very much for your reply @cfdman. It's just quite confusing as she has to specify my name and my national insurance within the application form because of tax reasons I guess? hence why I thought that it might be a joint application.

Has anyone tried the express service which you need to pay an extra £400?
Any good?
