ILR Eligibility - Help required

Post by Prak123 » Wed Jul 29, 2015 10:53 pm

Hi Experts

I first came to UK on 19-july-2009 and went back to India on 25-Jun-11. Processed a new Tier 2 ICT Long term Visa in Apr-2012 and came to UK in May-2012 and then i had 4 months break in 2013. Will i be able to apply for ILR if i am able to break all my absences with 180 days per year. Please note all these absences were due to my employment, right from 2009 till date i am working with same sponsor and same client. I went to offshore to setup and train the team, if i get a letter from employer that all my absences are for business purposes will my application for ILR be considered ?

Detailed break down of my stay in UK for last five years that i will be list in ILR application (which i am planning to do by end of this year)

24-Nov-10 to 23-Nov-11 - 180 days outside UK
24-Nov-11 to 23-Nov-12 - 180 days outside UK (maximum break in one trip is 314 days from 26-Jun-11 to 05-May-12)
24-Nov-12 to 23-Nov-13 - 146 days outside UK
24-nov-13 to 23-nov-14 - 22 days outside UK
24-nov-14 to 23-nov-15 - 0 days outside UK

Please note out of all these leaves 73 days are personal and remaining are for business purposes. Please note i went back to India on 25-Jun-11 and came back into UK on 05-May-12 with a new visa processed from India on 23-Apr-12

Thanks
Prakash-

Does this mean you applied for entry clearance after April 6, 2010? If this is the case you are not eligible for ILR as entry clearance applications for Tier 2 ICT submitted after that date do not lead to ILR.
