ILR for Dependant of Settled Person

Post by mdsadiqm » Tue Sep 30, 2014 10:48 am

Hi,

I have recently received my ILR from tier-1 general last april 2014, and my wife is currently on tier-1 dependant visa she arrived in this country before July 2012 and her current visa is valid until Oct 2015, i am assuming she is now eligible for Indefinite visa as she has completed her 2 years of dependent stay, could some one please let me know if she has to first apply for dependent visa to settled partner and then apply for ILR or to be precise which form should she be using ?

Thanks
Sadiq

She should be able to use Set O to apply for Settlement.

SET O is the same form i used to apply for ILR as a main applicant, is she using the same form as well ? i thought it would be SET M, who should be using SET M form then?

Thanks

SET(M) is for people who previously had leave as a partner of a Settled or British person (e.g. FLR(M) or spouse visa holders).

SET(O) is appropriate for PBS dependants who subsequently qualify for ILR, unless the PBS applicant obtained ILR under Long residence.

Myself and Vinny has already helped you.

There is no more to add.

I am confident we are correct and the one you spoke to is wrong.

It is entirely up to you, who you follow.
