ILR for my PBS Dependents

ILR for my PBS Dependents

Hi Friends,
I was granted ILR on basis of Tier2 migrant (Gen T2 + ICT Tier 2 + Workpermit holder) on 16.Mar.2015. My case was a bit complex so I did not apply in SET(O) for ILR of my dependents when I applied for my ILR.

Here is immigration history of my wife

1) Dependent Visa from Nov.2008 to May.2010. Entered UK Nov.2008
2) Obtained ICT Tier 2 dependent visa from India July.2010- entered the UK July.2010 - with no visa gap.(applied within 28 days of expiry)
3) Extension in the UK as dependent of ICT Tier 2 in July.2012, valid until Aug.2014. (Absent from Sept.2012 to May.2013).
4) I switch to tier 2 Gen hence she got Dependent of Gen TIer2 in Jan 2014. Still valid till Apr.2017 - she is on this visa.

Given she has been living in the UK as PBS dependent from as per rules before July.2012.
Children also living here for 2 years as PBS dependents.

Two queries please
1) I assume they need to apply using SET(O) using 2 year route for my wife.
2) IT's going to be postal applicaiton- do I have to submit my original Passport and ILR BRP as I have to travel urgently outisde the UK :(

Pl adivse as have to apply before Apr.2015 - to avoid fee hike.

Yes, SET(O). Full copies of your Passport and BRP should be ok.

Were your children born in the UK?

Hi Amber. Thanks, I scoured previous topics and used Set (O) for dispatch today. Thanks used copies only. Posting in this week saved me £ 1221, hopefully it will all be okay.

No kids were not born in the UK, but India.

Hi, I have a query on my friend"s behalf. He is married for 6+ yrs
He will finish his 10yrs in UK in July 2016, ( student+psw+dependent+teir2)
His wife will also finish 10 yr in 2016 in June. (Student+psw+teir2+dependent)
My question is can his wife apply ilr on 5 yrs basis (adding 3ys of teir2 and 2yrs of dependent on husband who in turn is on Teir2)

Or they don't have choice but to go via long term residency route?
Any info will be appreciated
